REPORTED vut and PLACED ON <br />SECOND READING on 6/3/91. <br /> <br />ORDINANCE NO. 35-91 <br /> <br />BY: B0.6CÁ..a, <br />Ge.iJltge., <br /> <br />Go.i1.aghvr., Gaizana, <br />GlLahcun, Ra:th, SmUh <br /> <br />AN EMERGENCY ORDINANCE establishing an early retirement <br />incentive plan for the City of Lakewood's Department of PUblic Works <br />and approving a one-year plan of operation. <br /> <br />WHEREAS, section 145.297 of the Ohio Revised Code author- <br />izes this Council to establish an early retirement incentive plan for <br />the City of Lakewood's Department of Public Works' employees who are <br />members of the Public Employees Retirement System of Ohio (PERS), and <br /> <br />WHEREAS, human resource benefits will accrue to the City of <br />Lakewood as a result of the establishment of an early retirement <br />incentive plan, and <br /> <br />WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal depart- <br />ment; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE' OF OHIO: <br /> <br />Section 1. That an early retirement incentive plan is <br />hereby authorized and established for the city of Lakewood's Depart- <br />ment of PUblic Works employees to be in effect for a period of one <br />year commencing on July 1, 1991, and terminating on June 30, 1992. <br />Said plan shall be in conformity with the provision~ of Section <br />145.297 of the Ohio Revised Code and Administrative Rule 145-15-04 <br />and shall operate in accordance with the terms, rules and procedures <br />set forth in Exhibit "AIf attached hereto and incorporated by refer- <br />epce herein. <br /> <br />Section 2. That the Director of Finance is hereby author- <br />ized and directed to execute any and all agreements, documents, <br />papers o~ memoranda necessary for the implementation and operation of <br />the early retirement incentive plan. <br /> <br />Section 3. That the early retirement incentive plan shall <br />be administered by the Office of Personnel in accordance with the <br />rules and procedures of the plan and Public Employees Retirement <br />System of Ohio, and in compliance with Section 145.297 of the Ohio <br />Revised Code. <br /> <br />Section 4. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its commit- <br />tees that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br />Section 5. That this ordinanc~ is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of tWo~thirds of all mem- <br />bers elected to Council, it shall take effect and be in force immedi- <br />ately upon its adoption and approval by the Mayor; otherwise, it <br />shall take effect and be in force after the earliest period allowed <br />by law. <br /> <br />Adopted: tt/W!./1¡ /19/ <br /> <br /> <br />Approved: r 11/ (qq/ <br /> <br />Á.AÞJ <br />~ <br />"',,, .. ~g-- <br />
