WHEREAS, section 145.297 of the Ohio Revised Code author- izes this Council to establish an early retirement incentive plan for the City of Lakewood's Department of Public Works' employees who are members of the Public Employees Retirement System of Ohio (PERS), and WHEREAS, human resource benefits will accrue to the City of Lakewood as a result of the establishment of an early retirement incentive plan, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal depart- ment; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE' OF OHIO: Section 1. That an early retirement incentive plan is hereby authorized and established for the city of Lakewood's Depart- ment of PUblic Works employees to be in effect for a period of one year commencing on July 1, 1991, and terminating on June 30, 1992. Said plan shall be in conformity with the provision~ of Section 145.297 of the Ohio Revised Code and Administrative Rule 145-15-04 and shall operate in accordance with the terms, rules and procedures set forth in Exhibit "AIf attached hereto and incorporated by refer- epce herein. Section 2. That the Director of Finance is hereby author- ized and directed to execute any and all agreements, documents, papers o~ memoranda necessary for the implementation and operation of the early retirement incentive plan. Section 3. That the early retirement incentive plan shall be administered by the Office of Personnel in accordance with the rules and procedures of the plan and Public Employees Retirement System of Ohio, and in compliance with Section 145.297 of the Ohio Revised Code. Section 4. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its commit- tees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 5. That this ordinanc~ is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of tWo~thirds of all mem- bers elected to Council, it shall take effect and be in force immedi- ately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
