The Plan shall be in effect for a <br />minimum of one (1) year. Should the City of Lakewood opt to <br />terminate the Plan, all Department of Public Works' employees <br />and PERS will receive written notice at least thirty (30) days <br />prior to the termination of the Plan. <br /> <br />9. Death of Plan Participant. If an employee dies prior to <br />receipt by PERS of any payments for service credit under the <br />Plan, a qualifying beneficiary shall be entitled 'only to those <br />payments provided by Sections 145.43 or 145.45 of the Revised <br />Code, exclusive of service credit which may have been available <br />under the Plan. <br /> <br />10. Administration of Plan. The Personnel Administrator will be <br />responsible for administering the Plan according to the <br />provisions set forth herein and with the Ohio Revised Code <br />Section 145.297, Administrative Rule 145-15-04, and the <br />policies and procedures of PERS. <br /> <br />11. Grievance Procedures. If the grieyant is not satisfied with the Personnel <br />Administrator's decision he or she may submit in writing a <br />further appeal to the City of Lakewood's Law Director. <br />within ten (10) working days the Law Director will notify <br />the grievant of his or her decision. Said ruling shall be <br />final and binding on all parties. <br />
