ORDINANCE NO. 46-91 <br /> <br />B~f: Bascia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Public Works Director to advertise <br />for bids and to enter into a contract with the lowest and best bidder after <br />advertisement according to law for the installation of new sewers on sections <br />of Elbur & Merl Avenues. <br /> WHEREAS, CouNcil has been advised that a plant permit requirement of <br />the Ohio Environmental Protection Agency necessitates the installation of <br />a bypass sewer to handle excess storm water flows, and <br /> WHEREAS, the construction drawings and specifications have been approved <br />by the Lakewood Engineering Division, and <br /> WHEREAS, the aforementioned construction drawings and specifications <br />are now on file in the office of the City Engineer, and <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br /> the usual daily operation of a municipal department and for the immediate <br /> preservation of the public safety and welfare; now, therefore <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Public Works Director be and he is hereby authorized <br /> and directed to advertise for bids and to enter into a contract with the <br /> lowest and best bidder after advertisement according to law for the <br /> installation of new sewers on sections of Elbur & Merl Avenues pursuant to <br /> plans and specifications on file in the office of the City Engineer. <br /> Section 2. That the cost of such construction is estimated at $300,000, <br /> which funds are to be made available from the Sewer Improvement Fund. <br /> Section 3. It is found and determined that all formal actions of of <br /> this Council concerning and relating to the passage of this ordinance were <br /> adopted in an open meeting of this Council,, and that all such deliberatiOns <br /> of this Council and of any of its committees that resulted in such formal <br /> actions were in meetings open to the public, in compliance with all legal <br /> requirements. <br /> Section 4. That this ordinance is hereby declared to be an emergency <br /> measure for the reasons stated in the preamble hereof and provided it receives <br /> the affirmative vote of two-thirds of all members elected to Council, it <br /> shall take effect and be in force immediately upon its adoption and approval <br /> by the Mayor; otherwise, it shall take effect and be in force after the <br /> <br />earliest period allowed by law. <br /> <br />Adopted: <br /> <br /> Clerk <br /> <br />Mayor <br /> <br />Approved: <br /> <br /> <br />
