ORDINANCE NO. 4 8 - 91 BY: Boscia, Gallagher, George, Graham, Roth, Smith AN EMERGENCY ORDINANCE fixing the compensation of the Clerk of the Lakewood Municipal Court, the time and method of payment thereof and repealing Ordinance No. 39-90 adopted April 17, 1990. WHEREAS, the Municipal Court Act, Revised Code Section 1901.31 provides that the legislative authority of this municipality shall fix the annual salary of the Clerk of Courts, and WHEREAS, the Act further provides that the compensation of the Clerk shall be paid three-fifths from the City Treasury and two- fifths from the Treasury of the County in which the City is located, and, WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department in that in the interest of public service, welfare, and safety, it is necessary to fix the compensation of the Clerk and direct the time and method of payment thereof, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the compensation of the Clerk of the Lakewood Municipal Court is hereby fixed at Forty-Eight Thousand Seven Hundred and Seven Dollars per annum effective April 1, 1991. Section 2. That the Director of Finance of the City of Lakewood is hereby authorized and directed to pay three-fifths ($29,224.20) of the compensation of the Clerk as herein fixed, from the City Treasury in semi-monthly installments or in equal installments every two weeks. Section 3. This ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor, and Ordinance No. 39-90 adopted April 17, 1990 and all other ordinances or parts of ordinances inconsistent herewith shall~--and are hereby ~d. ~/ / ~ ~r'esident Clerk Approved:~ ~j /flj a or ~
