<br />County, and to secure a receipt therefore, and is further authorized and directed <br />to certify to said County Auditory the last calendar year in which any Bonds or <br />Notes are scheduled to mature pursuant to the applicable Series Legislation. <br /> <br />Section 41. Documents. The Mayor and the Fiscal Officer, or either <br />of them, are authorized to prepare and deliver to any prospective purchaser of <br />Bonds or Notes authorized pursuant to a Series Legislation a Preliminary Official <br />Statement, and to prepare, execute and deliver to the Original Purchaser of Bonds <br />and Notes a final Official Statement, in connection with the sale and delivery <br />of the Bonds. <br /> <br />Section 42. Findinas and Recitals of Validitv. It is hereby <br />determined, represented and recited that all acts, conditions and things <br />necessary to be done precedent to and in the issuing of Bonds and Notes in order <br />to make such Bonds and Notes legal, valid and binding special obligations of the <br />Issuer have, or prior to the delivery thereof will have, happened, been done and <br />performed in re9'ular and due form as required by law; and that no limitation of <br />indebtedness or taxation, either statutory or constitutional, will have been <br />exceeded in the issuance of such Bonds and Notes. <br /> <br />Section 43. Compliance with Open Meetina Laws. It is found and <br />determined that all formal actions of this Legislative Authority concerning and <br />relating to the passage of this General Bond Legislation were taken in an open <br />meeting of this Legislative Authority, and that all deliberations of this <br />Legislative Authority and of any of its committees that resulted in those formal <br />actions were in meetings open to the public, in compliance with all legal <br />requirements, including the Charter and codified Ordinances of the Issuer. <br /> <br />Section 44. Governina Law. The provisions of this Ordinance and are <br />subject to the laws of the State of Ohio. <br /> <br />Section 45. Severabilitv. Each section of this Ordinance and each <br />subsection or provision of any section is hereby declared to be independent, and <br />the findin9' or holding that any section or any subsection or provision of any <br />section is invalid or void shall not be deemed or held to affect the validity of <br />any other section, subsection or provision of this Ordinance. <br /> <br />Section 46. Effective Date. This Ordinance is hereby declared to <br />be an emergency measure necessary for the immediate preservation of the public <br />peace, property, health, safety and welfare within the Issuer for the reasons set <br />forth and defined in the preamble to this ordinance; and provided it receives the <br />affirmative vote of two-thirds of all members elected to the Legislative <br />Authority, this ordinance shall take effect and be in force immediately upon its <br />passage by the Legislative Authority and approval by the Mayor; 0 ~t <br />shall take effect and be in force after the earlies iod allo ed b aw.
