ORDINANCE NO. 59-91 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE to make appropriations from the Capitol <br />Improvement Fund for the installation of curbs on Lakewood, ' Graber, <br />Olivewood and F. lbur Avenues. <br /> <br /> WHEREAS, an emergency exists for the immediate preservation of <br />the public property, health and safety and to provide for the usual daily <br />operation of municipal departments, and <br /> <br /> WHEREAS, the condition of these curbs is such that they are <br />non-repairable, and <br /> <br /> WHEREAS, by replacing the curbs the condition of the street will <br />be structurally improved and the life expectancy extended, now, therefore: <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That there be appropriated from the Capitol Improve- <br />ment Funds: <br /> <br />Curb Replacement <br /> <br />$ 2 83,000.00 <br /> <br /> Section 2. That the Director of Finance be and is hereby <br />authorized to draw checks upon the City depositories for the amounts <br />appropriated in this ordinance whenever claims' are presented, properly <br />approved, by the head of the Department for which the indebtedness is <br />incurred, provided the President of Council shall approve all claims of <br />the City Council. <br /> <br /> Section 3. In accordance with Article III, Section 14, of the <br />Charter of the City of Lakewood, Council hereby determines that the manner <br />of giving notice of the passage of this ordinance is to be by posting <br />copies hereof for a period of not less than fifteen (15) days, in not less <br />than five (5) of the most public places in the City, which places have been <br />determined by Council in Ordinance No. 55-59. <br /> <br /> Section 4. It is found and determined that all formal actions <br />of this ~ouncil concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council and of any of its <br />committees that resulted in such formal actions were in meetings open to <br />the public in compliance with all legal requirements. <br /> <br /> Section 5. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble, and provided it <br />receives the affirmative vote of two-thirds (2/3) of all members elected <br />to Council, it'shall take effect and be in force i~_i~d~ately upon its <br />adoption and approval by the Mayor. ~.~._/ff.f_, ~) <br /> <br /> Clerk <br /> <br />Approved: /~ ] ~J <br /> <br /> <br />
