Gai.lagher, Gazzana <br /> George, Graham, Roth, Smit <br /> <br /> AN ORDINANCE to supplement the Administrative Code of the <br /> Codified Ordinances by the enactment of Section 149.25 to establish <br /> the payment of prevailing wages on construction projects on city- <br /> owned land. <br /> <br /> WHEREAS, issues have arisen in other, charter cities with <br /> respect to the applicability of the state prevailing wage law (Cha <br /> ter 4115, Ohio Revised Code),:to constru 'P- <br /> the municipal ,, ~h ~_ ~ ..... _~ _ c~lon on property owned by <br /> ~ its w ....... ~= u~ sun~ecu~.o~ a ~ong-term land lease, and <br /> <br /> WHEREAS, City Council desires to express its policy that <br /> the prevailing wage be paid for construction performed on land owned <br /> by the City but subject to a long-term lease, and <br /> <br /> WHEREAS, payment of the prevailing wage on construction <br /> projects on city-owned land subject to long-term leases is within the <br /> spirit if not the precise letter of Chapter 4115, Ohio Revised Code, <br /> and <br /> <br /> WHEREAS, it is in the best interest of the City to require <br /> that the prevailing wage'be paid on construction on city-owned land <br /> which is the subject on a long-term lease; now, therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Administrative Code of the Codified <br /> Ordinances of the City of Lakewood be and they are hereby supplement- <br /> ed by the enactment of Section 149.25, to read as follows: <br /> <br /> /g'~ ~ 149.25 LEASE OF CITY-OWNED <br /> ~. ~ REALTY. <br /> ~.~_ (a) No City agency shall lease or a <br /> ~/ ~sublease of an~, real ..... uthorize the <br /> ~ ~operty owned by the City, <br /> upon which private or public improvements are <br /> planned to be constructed, without first obtaining <br /> authorization by ordinance of Council. <br /> <br /> (b) Unless specifically waived by ordinance of <br /> Council, all leases, assignments, subleases and. <br /> modifications theretO, authorized pursuant to this <br /> Section shall require that in all construction of <br /> private or public improvements situated on city'- <br /> owned land that prevailing wage rates shall be <br /> paid in constructing the improvement. The pre- <br /> vailing wage shall be defined in the same manner <br /> as Chapter 4115 of the Ohio Revised Code. <br /> <br /> (c) Subsection (b) herein does not apply when the <br /> real property is a gift or contribution to the <br /> City and at the time of the gift the construction <br /> of the specific public or private improvement was <br /> contemplated; or when a private party offers to <br /> contribute as a gift to the City the construction <br /> of improvement on City owned real property and a <br /> lease of less than two years of the real property <br /> is part of the transaction, and no City funds are <br /> involved in the project, <br /> <br /> Section 2. That this ordinance shall take effect and be in <br />force from and after the earliest period allowed by law. <br /> <br /> <br />
