AGREEMENT <br /> <br />Between the Board of County Commissioners of Cuyahoga County <br /> andthe.City of Lakewood for the <br /> interim resurfacing of West ll7th Street~(CR-252) <br /> from Berea Road to-Madison Avenue <br /> <br /> This agreement.entered 'into at Cleveland, 'Ohio this.~-~-~ day of <br />~TO~ ~x~--~., 19~__, by and between the County of Cuyahoga, Ohio, by its <br /> BOard o'f County Comm~ssioners,- Party of the First Part and hereinafter <br /> referred to as the COUNTY and t'he City of Lakewood by its~Mayor, having been <br /> duly authorized to enter into Said agreement by Ordinance No. ~ - ~, <br /> adopted by Council of the City of Lakewood on the ~ day of <br /> ~ 19¢/, Party of the Second Part and hereinafter referred to as <br /> -t-~?MUNICIPALITY. <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the MUNICIPALITY.has'recognized the 'need for and proposes ~he <br />improvement of a portion of public highway which is described as follows: <br /> The interim resurfacing of West ll7th Street (CR-252) from" <br /> Berea Road to Madison Avenue. <br /> <br /> WHEREAS, this project within the corporation limits of the <br />MUNICIPALITY is part of a larger project which is the interim <br />resurfacing of West ll7th Street (CR-252) from Bella~re Road to Madison <br />Avenue in the Cities of Lakewood and Cleveland. <br /> <br /> NOW THEREFORE, in consideration of the covenants and agreements herein <br />contained to be performed by the parties hereto, it is mutually agreed between <br />the parties hereto as follows: <br /> <br />A. CONSENT <br /> <br />That it is declared to be in the public interest that the consent of <br />said MUNICIPALITY be and such consent is hereby given to the COUNTY <br />to participate in the cost of construction of the.above described <br />improvement. <br /> <br />B. COOPERATION <br /> <br />Tha~ the COUNTY and the MUNICIPALITY will cooperate in the interim <br />resurfacing of West ll7th Street (CR-252) from Bellaire Road to <br />Madison Avenue. <br /> <br />e <br /> <br />That the MUNICIPALITY will prepare construction plans and <br />specifications, including necessary engineering reports, which shall <br />conform to generally accepted engineering practices and principles. <br /> <br />-1- <br /> <br /> <br />
