ORDINANCE NO. 88-91 BY: B0scia, Gallagher, George, <br /> Graham, R0'th, Smith <br /> <br /> AN EMERGENCY ORDINANCE to amend Chapter 9i3~of the Wastewater <br />Disposal Code of the Codified Ordinances of the City of Lakewood <br />relating to regulation of the use of muniCipal and private sewers and <br />drains and the discharge of .waters and waste into the public sewer <br />system. <br /> <br /> WHEREAS, the said Environmental Protection Agency requires <br />municipalities who accept design and construction grants to assure that <br />sewers are used in a proper .manner in compliance with applicable <br />~federal regulations and with good engineering'practices; and <br /> <br /> WHEREAS, pursuant to Ordinance 59-78 adopted July 5, 1978, <br />the City provided certain assurances of compliance, to the Federal <br />Environmental Protection Agency in connection with the City's <br />aPplication for its.Step 2 Grant and the proposed modification of the <br />wastewater treatment plant; and <br /> <br /> WHEREAS, the Environmental Protection Agency has mandated <br />certain changes in our existing Pretreatment Program to bring the City <br />into compliance with new Pretreatment Standards and this Council <br />determines it to be in the best interest of the City to enact such <br />legislation to incorporate the new regulations into our existing Sewer. <br />Use Program; and <br /> <br /> WHEREAS, an emergency exists to provide for the usual daily <br />operation of a municipal department arising from the necessity of <br />complying with the Environmental Protection Agency's modifications <br />of the approved pretreatment program and the immediate preservation of <br />the public peace, ~property, health, safety and welfare in the City. <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. <br />Ordinances of the <br />follows: <br /> <br /> That existing Section 913.02 (a) of the Codified <br />City of Lakewood, now reading respectively as <br /> <br />913.02 DEFINITIONS ...... <br /> <br />(a) <br /> <br />Unless the context specifically indicates otherwise, the following <br />terms, as used in this chapter, shall have the meanings <br />hereinafter designated: <br /> <br />(1) "Act" means the Federal Water pollution Control Act also <br /> known as the Clean Water Act, as amended, 33 U.S.C. 1251, et <br /> seq. <br />(2) "Biochemical oxygen demand (BOD5)" means the quantity of <br /> oxygen utilized in the biochemical oxidation of organic <br /> matter under standard laboratory procedure in five days at <br /> twenty degrees Centigrade expressed in terms of weight and <br /> concentration (milligrams per liter (mg/1)). <br /> (3) "Building drain" means that part of the lowest horizontal <br /> piping of a drainage system which receives the discharges <br /> from soil, waste and other drainage pipes inside the walls of <br /> the building and conveys it to the building sewer, beginning <br /> outside the inner face of the building wall. <br /> (4) "Building sewer" means the extension from the building drain <br /> to the Municipal sewer or other place of disposal. <br /> (5) "City" means the City of Lakewood or Council of Lakewood. <br /> (6) "commercial user" means a commercial business discharging <br /> wastewater; users not categorized as residential or <br /> industrial. <br /> (7) "Cooling water" means the water discharged from any use such <br /> as air conditioning, cOoling or refrigeration, or during <br /> which the only constituent added to the water is heat. <br /> (8) "Engineer" means the City Engineer or the Engineer's duly <br /> authorized deputy, agent or representative. <br /> <br /> <br />
