b) Ail industrial users shall promptly notify the City in <br />advance of any substantial change in the volumes or character <br />of pollutants in their discharge. <br /> <br />c) The City Engineer' may suspend the wastewater treatment <br />service and/or a Wastewater Discharge Permit when such <br />suspension is necessary, in the opinion of the City Engineer <br />in order to stop an actual~ or threatened discharge which <br />presents or may present an imminent or substantial <br />endangerment to the health or welfare of persons, to the <br />environment, or to the wastewater disposal syStem, or would <br />cause the City to violate any condition of its NPDES Permit. <br /> <br /> d) Any user notified of suspension of the wastewater <br /> treatment service and/or the Wastewater Discharge Permit <br />.shall immediately stop the discharge. In the event of a <br /> failure of the user to comply voluntarily with the suspension <br /> order, the City Engineer shall take such steps as deemed <br /> necessary, including immediate severance of the sewer <br /> connection to prevent or minimize damage to the wastewater <br /> disposal system or endangerment to any individuals. The City <br /> Engineer shall reinstate the Wastewater Discharge Permit <br /> and/or the wastewater treatment service upon proof of the <br /> elimination of the noncomplying discharge. A detailed <br /> written statement submitted by the user describing the causes <br /> of the slug or accidental discharge and the measure taken to <br /> prevent any future occurrence shall be .submitted to the City <br /> Engineer within fifteen (15) days of the date of occurrence. <br /> <br /> Section 14. That existing Section 913.19 of the Codified <br />Ordinances of the City of Lakewood, now reading as follows: <br /> <br />913.19 ANNUAL PUBLICATION. <br /> <br /> A list of the industrial users which were not in <br />compliance with any pretreatment requirement or standard at <br />least once during the twelve previous months, shall be <br />published annually in a local newspaper. The notification <br />shall also summarize any enforcement actions taken against <br />the user(s) during the same twelve months. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />Section 913.19 ANNUAL PUBLICATION. <br /> <br /> At least annually, the Director shall publish'a list Of <br />all industrial users which at any time during the previous <br />twelve months were in significant noncompliance with <br />applicable pretreatment requirements. For the purposes of <br />this provision, an industrial user is in significant <br />noncompliance if its violations meet one or more of the <br />following criteria: <br /> <br />a) Chronic violations of wastewater discharge limits, <br />defined here as those in which sixty-six percent or more of <br />all of the measurements taken during a six-month period <br />exceed (by any magnitude) the daily maximum limit or the <br />average limit for the same pollutant parameter; <br /> <br />b) Technical Review Criteria (TRC) violations, defined here <br />as those which thirty-three percent or more of all of the <br />measurements for each pollutant parameter taken during a <br />six-month period equal or exceed the product of the daily <br />maximum limit or the average limit~ multiplied by the <br />applicable TRC (TRC=i.4 for BOD, TSS, fats, oil and grease, <br />and 1.2 for all other pollutants except pH); <br /> <br />c) Any other violation of a pretreatment' effluent limit <br />(daily maximum of longer term average) that the Director <br />determines has caused, alone or in combination with <br />other discharges, interference or pass through (including <br />endangering 'the health of City personnel or the general <br />public); <br /> <br /> <br />
