Ohio this ~ day of <br /> Board of County Commissioners, Party of the First Part and hereinafter <br /> referred to as the COUNTY and the City of Lakewood by its Mayor, having been <br /> duly authorized to enter into said agreement by Ordinance No. ~-~/ <br />a~opted~_by Council of the City of Lakewood on the~x~_~ day <br />~:;~-~~, 19¢/, Party of the Second Part and hereinafter referred to as <br /> th~ MUNICIPALITY· <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the MUNICIPALITY has recognized the need for and proposes the <br />improvement of a portion of public highway which is described as follows: <br /> <br />The rehabilitation of Lakewood Heights Boulevard (CR-297) from <br />Woodward Avenue to Alger Road and from Lincoln Avenue to Berea <br />Road and the rehabilitation of Lakewood Heights Boulevard Bridges <br />No, 209 and 210 over the Cleveland Rapid Transit. <br /> <br /> WHEREAS, this project, within the corporation limits of the MUNICIPALITY, <br />is part of a larger project which is the rehabilitation of Lakewood Heights <br />Boulevard (CR-297) from Woodward Avenue to Alger Road and from Lincoln Avenue <br />to Berea Road and the rehabilitation of Lakewood Heights Boulevard Bridges No. <br />209 and 210 over the Cleveland Rapid Transit in the Cities of Lakewood and <br />Cleveland. <br /> <br /> NOW THEREFORE, in consideration of the covenants and agreements herein <br />contained to be performed by the parties hereto, it is mutually agreed between <br />the parties hereto as follows: <br /> <br />A. CONSENT <br /> <br />That it is declared to be in the public interest that the consent of <br />said MUNICIPALITY be and such consent is hereby given to the COUNTY <br />and the Ohio Department of Transportation to construct the above <br />described improvement in accordance with plans, specifications and <br />estimates approved by the COUNTY. <br /> <br />-1- <br /> <br /> <br />
