ORDINANCE NO. 95-91 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Public Works Director to advertise <br /> for bids and to enter into a contract with the lowest and best bidder after <br /> advertisement according to law for the Riverside Drive Water Main Replacement, <br /> <br /> WHEREAS, the aforementioned construction drawings and specifications <br /> are being prepared in the office of the City Engineer, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for <br /> the usual daily operation of a municipal department and for the immediate <br /> preservation of the public safety and welfare; now, therefore <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Public Works Director be and he is hereby authorized <br /> and directed to advertise for bids and to enter into a contract with the <br /> lowest and best bidder after advertisement according to law for the Riverside <br /> Drive Water Main Replacement pursuant to plans and specifications now being <br /> prepared in the office of the City Engineer. <br /> <br /> Section 2. That the cost of such construction is estimated at $575,000, <br />which funds are to be made available from the Water Fund. <br /> <br /> Section 3. It is found and determined that all formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted <br />in an open meeting of this Council, and that all such deliberations of this <br />Council and of any of its committees that resulted in such formal actions <br />were in meetings open to the public, in compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it <br />shall take effect and be in force immediately upon its adoption and approval <br />by the Mayor; otherwise, it shall take effect and be in force after the <br />earliest period allowed by law. <br /> <br />Adopted: <br /> <br />Approved: <br /> <br />! <br /> <br /> Clerk <br /> <br /> Mayor <br /> <br /> <br />
