PLEASE SUBSTITUTE FOR ORDINANCE 98-91 <br />originally submitted with this evening <br />docket. <br /> <br />ORDINANCE NO. 98-91 BY: <br /> / <br /> <br />Gallagher, Gazzana, George, <br />Graham, Roth, Smith <br /> <br />AN EMERGENCY ORDINANCE to make additional appropriations for Waste Water <br />System Improvements of the the City of Lakewood, State of Ohio, for the fiscal <br />year ending December 31, 1991. <br /> <br />WHEREAS, an emergency exists to provide for the immediate preservation of <br />the public property, health and safety and to provide for the usual daily <br />operation of municipal departments, to wit: the water system construction <br />must be done by February 1, 1992 to proceed on schedule with the Lakewood <br />City Center Project, and <br /> <br />WHEREAS, the aforementioned construction drawings and specifications are <br />being prepared in the office of the City Engineer; now, therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That there be appropriated from the Capital Projects Fund: <br /> <br /> Water Fund $ 95,000 <br /> <br /> Section 2. That the Acting Director of Finance be and he is hereby authorized <br /> to draw checks upon the City depositories for the amounts appropriated in <br /> this ordinance whenever claims are presented properly approved by the head <br /> of the department for which the indebtedness is incurred, providing the <br /> President of Council shall approve all claims of the City Council. <br /> Section 3. It is found an determined that all formal actions of this Council <br /> concerning and relating to the passage of this ordinance were adopted in <br /> an open meeting of this Council, and that all such deliberations of this <br /> Council and of any of its committees that resulted in such formal action <br /> were in meetings open to the public in compliance with all legal requirements. <br /> Section 4. That this ordinance is hereby declared to be an emergency measure <br /> for the reasons stated in the preamble hereof and provided it receives the <br /> affirmative vote of two-thirds of all members elected to Council, it shall <br /> take effect and be in force immediately upon its adoption and approval by <br /> the Mayor; otherwise, it shall take effect and be in force after the earliest <br /> period allowed by law. <br /> <br />Adopted: <br /> <br />Approved: ~ ~ -~* /'2 ~// ---"'r' . <br /> J Mayor ~, <br /> <br /> <br />
