Service Charges due and payable in each such year for all <br />outstanding Bonds and Notes issued under this General <br />Bond Legislation equals or exceeds 1.10. For purposes of <br />this Section the Bond Service Charges due and payable on <br />such additional and/or outstanding Notes shall be the <br />estimated Bond Service Charges on the Bonds in <br />anticipation of the issuance of which such Notes are to <br />be or have been issued, such an estimate to be made <br />assuming (i) the same number of annual principal payments <br />for such Bonds as is or is to be set forth in the Series <br />Legislation relating to such Notes, (ii) the first <br />payment of principal of such Bonds is made in the year of <br />calculation, and (iii) estimated rates of interest equal <br />to the rates of interest the Bonds would bear if issued <br />as of the date of calculation.,, <br /> <br /> Pursuant to subsection (a)(vi) of Section 38 of the <br /> General Bond Legislation, Section 15 of the General Bond <br /> Legislation is hereby amended in its entirety to read as follows: <br /> <br /> "Section 15. Fiscal Agent and Registrar. <br /> The Huntington National Bank, Columbus, Ohio, is hereby <br /> designated and appointed as (a) Fiscal Agent for the <br /> Bonds and Notes pursuant to Section 133.25(B) of the Ohio <br /> Revised Code and (b) as Registrar for Bonds." <br /> <br /> Existing subsection (b) of Section 4 and existing Section <br />15 of the General Bond Legislation are each hereby repealed. <br /> <br /> Section 14. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and any of its <br />committees that resulted in such formal action, were in meetings <br />open to the public, in compliance with all legal requirements <br />including the Issuer's Charter and Codified Ordinances. <br /> <br /> Section 15. This ordinance is hereby declared to be an <br />emergency measure necessary for the immediate preservation of the <br />public peace, property, health, safety and welfare in the Issuer <br />for the reasons set forth and defined in the preamble to this <br />ordinance, and provided it receives the affirmative vote of <br />two-thirds of all members elected to Council, this ordinance shall <br /> <br />-13- <br /> <br /> <br />
