ORDINANCE NO. 4-92 <br /> <br /> BY: Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 1321,02(c) of the <br />Building Code of the Codified Ordinances of the City of Lakewood to <br />provide for the addition of a fee for written examinations for plumb- <br />ing, electrical and heating and air conditioning contractors. <br /> <br /> WHEREAS, the City of Lakewood requires written examinations <br />as to the qualifications and competency of contracators to perform <br />plumbing, electrical and heating and air conditioning work, and <br /> <br /> WHEREAS, there as been no fee for this examination since <br />the adoption of the licensing requirements in 1979, and <br /> <br /> WHEREAS, the cost to the City of administering such exami- <br />nations has increased substantially since 1979, and <br /> <br /> WHEREAS, numerous surrounding cities who do not provide <br />such examinations refer contractors to the City of Lakewood for such <br />examinations and-licensing before accepting them to do work in their <br />cities, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for. the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal depart- <br />ment in that the examination fee is necessary to control the escalat- <br />ing costs to the City of administering such examinations; now, there- <br />fore, .~ <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Section 1321.02(c) of the Building Code of <br />the Codified Ordinances of the City of Lakewood, now reading as <br />follows: <br /> <br />1321.02 APPLICATION. <br /> <br />(b) . . . <br /> <br />(c) If the applicant does not qualify based upon <br />section (b), a written examination as to the <br />qualifications and competency to perform the work <br />for which the application is sought shall be <br />conducted by the Building Commissioner based on <br />the minimum standards as set forth in the applica- <br />ble codes and ordinances. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />1321.02 APPLICATION. <br /> <br />(b) . . . <br /> <br />(c) If the applicant does not qualify based upon <br />subsection (b) herein, a written examination as to <br />the qualifications and competency to perform the <br />work for which the application is sought shall be <br />conducted by the Building Commissioner based upon <br />the minimum standards as set forth in the applica- <br />ble codes and ordinances. A fee of Twenty-five <br />($25.00) Dollars shall be paid at the time of <br />the examination and each examination thereafter. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its commit- <br />tees that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> <br />
