ORDINANCE NO. 4-92 BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN EMERGENCY ORDINANCE to amend Section 1321,02(c) of the Building Code of the Codified Ordinances of the City of Lakewood to provide for the addition of a fee for written examinations for plumb- ing, electrical and heating and air conditioning contractors. WHEREAS, the City of Lakewood requires written examinations as to the qualifications and competency of contracators to perform plumbing, electrical and heating and air conditioning work, and WHEREAS, there as been no fee for this examination since the adoption of the licensing requirements in 1979, and WHEREAS, the cost to the City of administering such exami- nations has increased substantially since 1979, and WHEREAS, numerous surrounding cities who do not provide such examinations refer contractors to the City of Lakewood for such examinations and-licensing before accepting them to do work in their cities, and WHEREAS, this ordinance constitutes an emergency measure providing for. the immediate preservation of the public health, safety and welfare, and for the usual daily operation of a municipal depart- ment in that the examination fee is necessary to control the escalat- ing costs to the City of administering such examinations; now, there- fore, .~ BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 1321.02(c) of the Building Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 1321.02 APPLICATION. (b) . . . (c) If the applicant does not qualify based upon section (b), a written examination as to the qualifications and competency to perform the work for which the application is sought shall be conducted by the Building Commissioner based on the minimum standards as set forth in the applica- ble codes and ordinances. shall be and the same is hereby amended to read as follows: 1321.02 APPLICATION. (b) . . . (c) If the applicant does not qualify based upon subsection (b) herein, a written examination as to the qualifications and competency to perform the work for which the application is sought shall be conducted by the Building Commissioner based upon the minimum standards as set forth in the applica- ble codes and ordinances. A fee of Twenty-five ($25.00) Dollars shall be paid at the time of the examination and each examination thereafter. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its commit- tees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
