PLEASE SUBSTITUTE FOR ORDINANCE NO. 21-92, placed <br />1st READING on 3/2/92 and on 2nd Reading 4/20/92. <br /> <br />on <br /> <br />ORDINANCE NO. 21-92 <br /> <br />BY: Bosaia, Gallagher, G~orge, <br /> Gibbons, Roth, Se~ie, Smith <br /> <br /> AN ORDINANCE to amend the Building Code of the Codified <br />Ordinances of the City of Lakewood by amending RBC 1603.32 and RBC <br />1603.321 of Section 1303.04 and Sections 1305.43(a), 1305.44(b) and <br />(c), 1305.47 and 1305.49. <br /> <br /> WHEREAS, the preservation and maintenance of the housing <br />stock of the City is vital to the preservation of the high quality of <br />life enjoyed by the residents of Lakewood, and <br /> <br /> WHEREAS, studies and inspections made by the Building <br />Department, Community Development Department and independent agencies <br />all confirm that the greatest concentration of code violations and <br />deterioration occurs in rental dwelling units, and <br /> <br /> WHEREAS, consultants and experts both inside and outside <br />City government agree that regular and frequent inspections of the <br />category of residential units in which violations are most likely to <br />occur are the most cost efficient method of guarding against <br />deterioration, and <br /> <br /> WHEREAS, the efficient and economical targeting of City <br />resources to inspection of rental dwelling units will be enhanced by <br />requiring point of sale inspection'of all rental dwelling units and <br />the requirement of housing licenses for' such units; now/ therefore, <br /> <br />BE IT RESOLVED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That RBC 1603.32 and RBC 1603.321 of Section <br />1303.04 of the Building Code of the Codified Ordinances of the City of <br />Lakewood now reading as follows: <br /> <br />1303.04 AMENDMENTS, ENACTMENTS OR REPEALS. <br /> <br />RBC 1603.32 <br /> <br />FURNISHING OF CERTIFICATE TO PURCHASER <br /> OF MULTIPLE DWELLING. <br /> <br />Whoever sells, conveys, ].eases or otherwise <br />transfers an interest in real property, which has <br />situated thereon a multiple dwelling as classified <br />in Section 1621.04, shall secure a Certificate of <br />Occupancy from the Building Official and shall <br />furnish said Certificate to the purchaser, lessee <br />or transferee prior to the execution of the land <br />contract or the delivery of the deed, lease or <br />conveyance. Whoever fails to comply with the <br />provisions of this Section shall be guilty of a <br />misdemeanor, and upon conviction thereof, shall be <br />fined not less than One Hundred Dollars [$100.00), <br />nor more than One Thousand Dollars ($1,000.00). <br /> <br />RBC 1603.321 DUTIES OF ESCROW AGENT. <br /> <br />No person, firm or corporation acting in the <br />capacity of an escrow agent in any real estate <br />transaction involving the sale of Multiple <br />Dwellings as classified in Section 1621.04 shall <br />transfer title or distribute funds until there has <br />been deposited in escrow an acknowledgement from <br />the buyer of the receipt of a copy of the <br />Certificate of Occupancy required by Section <br />1603.32 and the provisions of said Section 1603.32 <br />have been complied with. Whoever fails to comply <br />with the provisions of this section shall be guilty <br />of a misdemeanor of the four'th degree. <br /> <br />shall be and the Same is hereby amended to read as follows: <br /> <br /> <br />
