(3) . <br />(4) . <br />(5) . <br />(6) . <br />(7) . <br />(8) . . <br /> <br />(9) <br /> <br />Paragraphs (1) thru (8) hereof notwithstanding, the <br />Court may, based on the facts and circumstances of <br />individual cases, impose an alternative sentence <br />when the court, in a written order, finds any of <br />the following: <br /> (i) space at the incarceration facility where <br /> the offender would be required to serve <br /> the term of imprisonment is unavailable; <br /> (ii) the health of the offender poses a <br /> significant risk to himself or other <br /> inmates at the facility; <br /> (iii) the facility is not equipped to properly <br /> ~are for a person of the age of the <br /> offender; <br /> (iv) extraordinary circumstances exist which <br /> impose a significant unusual expense or <br /> risk upon the City by virtue of the <br /> incarceration. <br /> <br /> (h) Repealed. <br /> (i) Penalty for Physical Control. Whoever violates subsection <br />(d) hereof is guilty of a misdemeanor of the first degree and <br />shall be subject to the penalty provided in Section 303.99(b). <br /> <br /> Section 2. That Section 333.021 of the Traffic Code of the <br />codified Ordinances of the City of Lakewood now reading as <br />follows: <br /> <br />333.021. OPERATION <br />DISREGARD OF SAFETY. <br /> <br />IN WILLFUL OR 'WANTON <br /> <br />(a) <br /> <br />No person <br />street or <br />disregard <br />property. <br /> <br /> shall operate a vehicle on any <br /> highway in willful or wanton <br />of the safety of persons or <br /> <br />(b) <br /> <br />No person shall operate a vehicle on any <br />public or private property other than <br />streets or highways, in willful or wanton <br />disregard of the safety of persons or <br />property. This subsection does not apply to <br />the competitive operation of vehicles on <br />public or private property when the owner of <br />such property knowingly permits such <br />operation thereon. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />333.021.
