R~P~RR~D to the FINANUN UommltZee on ORDINANCE NO. 62-92 BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN ORDINANCE to amend the Administrative Code of the Codi- fied Ordinances of the City of Lakewood by enacting new Section 111.10 relating to cooperative purchasing. WHEREAS, Section 5513.01(B) of the Ohio Revised Code pro- vides the opportunity for counties, townships and municipal corpora- tions to participate in contracts of the Ohio Department of Transpor- tation for the purchase of machinery, materials, supplies or other articles; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: 'Section 1. That the Administrative Code of the Codified Ordinances of the City of Lakewood be amended by the enactment of new Section 111.10 to read as follows: 111.10 COOPERATIVE PURCHASING. (a) The Mayor, Director of Finance, Director of Law and the Director of Public Works, subject to approval by the Board of Control, are hereby granted authority to Participate in contracts of the Ohio Department of Transportation for the purchase of machinery, materials, supplies or other articles which the Department has entered into pursuant to R.C. Section 5513.01(B); (b) The Mayor, Director of Finance, Director of Law and Director of Public Works, subject to the approval of the Board of Control, are hereby authorized to agree to be bound by all terms and conditions as the Director of Transportation prescribes; (c) The Mayor, Director of Finance, Director of Law and Director of Public Works, subject to the approval of the Board of Control, are hereby authorized to agree to directly pay the vendor, under each such contract of the Ohio Department of Transportation in which the City participates, for items it receives pursuant to the contract; (d) the City agrees to hold the Director of Transportation and the Department of Transporta- tion harmless for any claim or dispute arising out of participation in a contract pursuant to R.C. Section 5513.01(B). Section 2. That the Clerk of Council be and she is hereby directed to forward a certified copy of this Resolution to the Admin- istrator of the Bureau of Purchasing, Ohio Department of Transporta- tion. Section 3.
