ORDINANCE: 88-92 BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN EMERGENCy ORDINANCE authorizing the Mayor, on behalf of the City, to enter into an agreement with the Northeast Ohio Regional Sewer District (District) providing for the partial payment by the District of the recently completed West ll7th Street sewer rehabilitation project and for the transfer of ownership of certain sewers now held by the District to the City. WHEREAS, pursuant to a contract dated July 29, 1965 and adopted by Lakewood Ordinance No. 55-65, the City and the City of Cleveland agreed to the joint ownership and .maintenance of certain sewers, and WHEREAS, the Board of Trustees of the District, by resolution No. 169-73, assumed the duties and obligations of the City of Cleveland under the aforementioned agreement, and WHEREAS, the parties to the aforemelntioned agreement determined that the West ll7th Street sewer was in need of reconstruction and repair, and WHEREAS, the District and the City agreed that the District will contribute a portion of the reconstruction costs associated with the recently completed rehabilitation of the West ll7th Street sewer, and WHEREAS, the District and the City desire to transfer ownership of certain sewers currently held by the District to the City affecting the billing of sewer services to the citizens of the City, and WHEREAS, this Council has determined that it is in the best interest of the City to authorize the Mayor, for and on behalf of the City, to enter into an agreement with the District regarding the recently completed repairs of the West llTth Street sewer and the transfer of ownership of other related sewers to the City, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department in that the West ll'7th Street sewer repair project was completed May 15, 1992 and the aforementioned agreement expired in July of 1990; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO Section 1. That the Mayor, for and on behalf of the City, is hereby authorized to .enter into a contract with the Northeast Ohio Regional Sewer District (District) regarding the repair and rehabilitation of the West llTth Street sewer. The District agreed to pay a portion of the City's material and labor costs related to the project. Section 2. That the Mayor, for and on behalf of the City, is hereby authorized to enter into an agreement with ' the District whereby the ownership of certain sewers now held by the District shall be transferred to the City.
