ORDINANCE NO. <br /> <br />96-92 <br /> <br />BY: Boscia, Gallagher, George, <br />Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE to make additional appropriations for <br />expenditures of the for the fiscal year ending December 31, 1992 <br />and authorizing the Mayor to enter into a one year agreement with <br />The Greater Cleveland Ecology Association ("GCEA"), providing for <br />payment for leaf composting and the City's membership in the <br />Association. <br /> <br /> WHEREAS, the City will realize monetary savings and ecological <br />benefits by leaf disposal through the cooperative efforts of the <br />GCEA, and <br /> WHEREAS, an emergency exists to provide for the immediate <br />preservation of the public health, safety and welfare and the usual <br />daily operation of a municipal department in that the City must <br />dispose of approximately 30,000 cubic yards of leaves in a <br />satisfactory and safe manner before January 1, 1993; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That $35,000 be and is hereby apPropriated, as an <br />additional appropriation, from the General Fund for the City's <br />membership fee and leaf deposit charges to the Greater Cleveland <br />Ecology Association ("GCEA"). <br /> <br /> Section 2. That the Mayor on behalf of the City of Lakewood <br />be and he is hereby directed to enter into an agreement with "GCEA" <br />for membership and for the disposal of leaves as hereby described <br />in Exhibit "A" attached hereto and incorporated by reference <br />herein, said Agreement to be substantially in the form of Exhibit <br />"A" with such additional provisions as are acceptable to the <br />Director of Law to protect the public interest, hereinafter <br />referred to as.the Agreement. <br /> <br /> Section 3. That the Director of Finance be and he is hereby <br />authorized to draw checks upon the City depositories for the <br />amounts appropriated in this ordinance whenever claims are properly <br />presented and approved by the Director of Public Works. <br /> <br /> Section 4. That pursuant to the conditions of the <br />aforementioned Agreement, Council hereby formally approves the <br />payment of the one time fee of Three Thousand ($3,000) Dollars upon <br />execution of the Agreement and the fee of One ($1) Dollar per cubic <br />yard of leaves deposited at GCEA's site in accordance with the <br />terms and conditions set forth therein and approves and ratifies <br />the actions of the Mayor and Law Director as of this date. <br /> <br /> Section 5. That Council hereby authorizes and directs the <br />Director of Public Works to serve, if elected, as a trustee and/or <br />officer of the The Greater Cleveland Ecology Association to protect <br />the City's interest. <br /> <br /> Section 6. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 7.
