ORDINANCE NO. 96-92 BY: Boscia, Gallagher, George, Gibbons, Roth, Seelie, Smith AN EMERGENCY ORDINANCE to make additional appropriations for expenditures of the for the fiscal year ending December 31, 1992 and authorizing the Mayor to enter into a one year agreement with The Greater Cleveland Ecology Association ("GCEA"), providing for payment for leaf composting and the City's membership in the Association. WHEREAS, the City will realize monetary savings and ecological benefits by leaf disposal through the cooperative efforts of the GCEA, and WHEREAS, an emergency exists to provide for the immediate preservation of the public health, safety and welfare and the usual daily operation of a municipal department in that the City must dispose of approximately 30,000 cubic yards of leaves in a satisfactory and safe manner before January 1, 1993; now, therefore BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That $35,000 be and is hereby apPropriated, as an additional appropriation, from the General Fund for the City's membership fee and leaf deposit charges to the Greater Cleveland Ecology Association ("GCEA"). Section 2. That the Mayor on behalf of the City of Lakewood be and he is hereby directed to enter into an agreement with "GCEA" for membership and for the disposal of leaves as hereby described in Exhibit "A" attached hereto and incorporated by reference herein, said Agreement to be substantially in the form of Exhibit "A" with such additional provisions as are acceptable to the Director of Law to protect the public interest, hereinafter referred to as.the Agreement. Section 3. That the Director of Finance be and he is hereby authorized to draw checks upon the City depositories for the amounts appropriated in this ordinance whenever claims are properly presented and approved by the Director of Public Works. Section 4. That pursuant to the conditions of the aforementioned Agreement, Council hereby formally approves the payment of the one time fee of Three Thousand ($3,000) Dollars upon execution of the Agreement and the fee of One ($1) Dollar per cubic yard of leaves deposited at GCEA's site in accordance with the terms and conditions set forth therein and approves and ratifies the actions of the Mayor and Law Director as of this date. Section 5. That Council hereby authorizes and directs the Director of Public Works to serve, if elected, as a trustee and/or officer of the The Greater Cleveland Ecology Association to protect the City's interest. Section 6. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 7.
