<br />AGREENENT <br /> <br />THIS AGREENENT made and concluded at Lakewood, Ohio, this ~ <br /> <br />day of <br /> <br />, 1993, by and between the CITY OF LAKEWOOD, <br /> <br />Ohio, 12650 Detroit Avenue, Lakewood, Ohio (hereinafter referred to <br /> <br />as "city") and the Lakewood City Schools, Board of Education, 1430 <br /> <br />Warren Road, Lakewood, Ohio (hereinafter referred to as "City <br /> <br />Schools") . <br />WHEREAS, the City has granted to Cox Cable Cleveland Area, <br /> <br />Inc. a non-exclusive franchise to provide cable television service <br />to the residents of the City, and has renewed said franchise <br /> <br />agreement for 15 years commencing on June 19, 1987; and <br /> <br />WHEREAS, Cox Cable Company is obligated to pay the City a <br /> <br />franchise fee of five percent (5%) of the Company's gross monthly <br /> <br />subscriber service revenues, less unpaid monthly subscriber service <br /> <br />charges, but including any annual or periodic prepayment of monthly <br /> <br />service charges, for the Company's previous fiscal year; and <br />WHEREAS, pursuant to federal statutes and regulations, the <br /> <br />City has deposited the proceeds of two of the five percent of the <br />franchise fee in a Cable Franchise Trust FUnd for the purposes of <br /> <br />improving the programming opportunities for community groups and <br /> <br />the City Schools; and <br />WHEREAS, there are currently funds available in the Cable <br /> <br />Franchise Trust Fund for said purposes; and <br /> <br />WHEREAS, the City desires to fund the purchase, maintenance <br /> <br />and operation by and for the City Schools of certain video <br /> <br />1 <br /> <br />I!'""',,;:"<\n'f <br />," ¿< iI"'" crr., <br />'::"'..r",. ;ai!C.-1", <br /> <br />rJ <br />
