might enter the premises upon which the work is being <br />conducted shall be covered to prevent infiltration. <br /> <br />(f) No such activity shall be permitted under any permit <br />issued in accordance with this chapter which violates <br />Chapter 515 of the General Offenses Code. <br /> <br />(g) No paint removal process which presents a risk of <br />generating dust particles containing lead nor any gasoline <br />or propane fired torch shall be used to remove any <br />lead-based paint on any exterior surface except in <br />compliance with the procedures set forth herein. Where any <br />such process is proposed to be employed, the applicant <br />shall provide the Building Commissioner and the Director of <br />Human Services, in a form acceptable to them, with test <br />results indicating the lead content of the paint to be <br />removed, the cost of required testing to be borne by the <br />applicant. If the lead content equals or exceeds 1 mg/cm2 <br />(current Federally recognized maximum acceptable lead <br />concentrations), no permit shall be issued. As a condition <br />of any permit being issued, the property owner shall <br />authorize an agent of the City onto the premises at any <br />time between the hours of 8:00 a.m. and 5:00 p.m. Monday to <br />Friday to conduct unannounced testing of paint to be <br />removed, the partiCles generated by the process, and the <br />surfaces affected. If the City's test with an X-Ray <br />fluorescence analyzer (XFR) or other method approved by the <br />U. S. Department of Housing and Urban Development (HUD) <br />indicates a lead content equal or exceeding 1 mg/cm2, the <br />paint removal shall be immediately halted and the permit <br />revoked. <br /> <br />(h) After completion of the work to be performed under the <br />permit or its revocation, the permittee shall be required <br />to thoroughly clean up all residue from the permit <br />premises, adjacent property, and public rights of way or <br />thoroughfares. In addition, the permittee shall ensure <br />that no paint removal and/or cleanup is performed in such a <br />manner as to cause or create a public nuisance and shall <br />further ensure that the cleanup of the work area is in such <br />a manner as not to cause or create a public nuisance. The <br />permittee shall be required to notify the Building <br />Commissioner of the completion of work and shall respond <br />immediately to any finding of deficiency by the Building <br />Commissioner with regard thereto. <br /> <br /> Section 3. That Section 1335.11 of the Building Code of the <br />Codified Ordinances of the City of Lakewood now reading as follows: <br /> <br />1335.11 INTERPRETATION OF CHAPTER <br /> <br />(a) Nothing contained in this chapter shall be deemed to <br />exempt the applicant or permittee from the provisions of <br />any other section of these Codified Ordinances, or from the <br />payment of any other fee or from the necessity of obtaining <br />any other permit required under these Codified Ordinances. <br /> <br />(b) Nothing in this chapter shall be deemed to require that <br />a homeowner must obtain a permit, prior to paint removal or <br />exterior cleaning of property which that person owns and <br />occupies, for methods of removal or cleaning which could <br />not be characterized as a commercial process. <br /> <br />shall be and the same is hereby amended to read as follows: <br /> <br />1335.11 INTERPRETATION OF CHAPTER <br /> <br />(a) Nothing contained in this chapter shall be deemed to <br />exempt the applicant or permittee from the provisions of <br />any other section-of these Codified Ordinances, or from the <br />payment of any other fee or from the necessity of obtaining <br /> <br />3 <br /> <br /> <br />
