PLEASE SUBSTITUTE FOR ORDINANCE NO. 38-93 <br />PLACED ON FIRST READING & REFERRED TO THE <br />CMTE OF THE WHOLE on 7/6/93; SECOND READING <br />7/19/93. <br /> <br />ORDINANCE NO. <br /> <br />38-93 <br /> <br />AMENDED <br /> <br /> BY: Boscia, Gallagher, George, <br /> Gibbons, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the <br />Director of Public Works to enter into an agreement with the City of <br />Cleveland for the disposal of refuse at the Ridge Avenue Transfer <br />Station which is owned and operated by the City of Cleveland. <br /> <br /> WHEREAS, pursuant to Section 735.053 of the Ohio Revised <br />Code and Section 111.04(a)(8) of Lakewood's Codified Ordinances, the <br />City is authorized to enter into an agreement with the City of <br />Cleveland without competitive bidding. <br /> <br /> WHEREAS, 'the City has already appropriated sufficient funds <br />to meet the maximum amount that may be paid to the Ridge Avenue <br />Transfer Station for 1993 and subject to City Council's approval, the <br />City. has appropriated sufficient funds to meet the maximum amount that <br />may be paid to the Ridge Avenue Transfer Station of 1994 and 1995. <br /> <br /> WHEREAS, recent amendments to the Ohio Revised Code have <br />reduced the maximum load-weight of vehicles using improved public <br />highways, streets, bridges, and culverts, and <br /> <br /> WHEREAS, due to said weight restrictions the City will be <br />required to reduce the load-weight of its refuse vehicles travelling <br />to and from the present landfill site resulting in an increase in <br />frequency of deliveries to dispose of the same volume of refuse, and <br /> <br /> WHEREAS, the present landfill sight is approximately <br />fifty-one miles from the City and the proposed Ridge Avenue Waste <br />Transfer Station is nine miles from the City, and <br /> <br /> WHEREAS, continued use of the present landfill site will <br />increase operational costs by adding mileage and maintenance expense <br />for the City's aging fleet of refuse vehicles as necessitating the <br />hiring of three additional drivers, and <br /> <br /> WHEREAS, the charge to the City for use of the Ridge Avenue <br />Waste Transfer Station will be $21.70 per ton of refuse and the charge <br />to the City for use of the previous landfill sight was $27.88 per ton <br />of refuse, and <br /> <br /> WHEREAS, the increased per-ton charge to the City will be <br />off-set by the reduction in mileage, maintenance, and personnel costs <br />resulting in a savings to the City of approximately $340,000, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety, <br />and welfare and for the usual daily operation of a municipal <br />department for the reason that delivery of refuse to the City of <br />Cleveland's Ridge Avenue Waste Transfer Station will reduce landfill, <br />maintenance, mileage, and personnel costs to the City and reduce wear <br />and tear on the City's aging fleet of refuse vehicles; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Director of Public Works on behalf of <br />the City of Lakewood is hereby authorized and directed to enter into <br />an agreement with the City of Cleveland for the disposal of refuse as <br />hereby described in Exhibit "A" attached hereto and incorporated by <br />reference herein, said Agreement to be substantially in the form 'of <br />Exhibit "A" with such additional provisions as are acceptable to the <br /> <br /> <br />
