EXHIBIT "A" <br /> REFUSE AGREEMENT <br /> WITH THE CITY-~-'-~E~ELAND <br /> <br /> This Aqreement is made and entered into on the -----_ day of _, <br />and shall remain in effect throuqh _ day of between the City <br />of Lakewood (hereinafter referred t~ as Lakewood) and the City of Cleveland <br />(hereinafter referred to as ~Cleveland) with the purpose of allowinq Lakewood <br />to deliver refuse to the Ridge Avenue Waste Transfer Station (hereinafter <br />referred to as Transfer Station) which is owned and operated by Cleveland. <br /> <br /> Pursuant to Section 735.053 of the Ohio Revised Code and Section <br />111.04(a)(8) of Lakewood's Codified Ordinances, Lakewood is authorized t0 <br />enter into this Aqreement with Cleveland without competitive biddinq. The <br />followin~ are the conditions of the A~reement: <br /> <br /> 1. Pursuant to Section 735.053(A) of the Ohio Revised Code, Lakewood <br /> designates and authorizes its Director of Public Works to enter into <br /> this A~reement with Cleveland. <br /> <br />2. Pursuant to Section 735.053(B) of the Ohio Revised Code, the charqe <br /> to Lakewood for the use of the Transfer Station will be $21 70 per <br /> ton of refuse. ' <br /> <br />3. Pursuant~to Section 735.053(C) of the Ohio Revised Code, the Transfer <br /> Station will dispose of~Lakewood's refuse. <br /> <br />4. Pursuant to Section 735.053(D) of the Ohio Revised Code, Lakewood has <br /> appropriated sufficient funds to meet the maximum amount that may be <br /> paid to the Transfer Station for 1993. Subject to City Council's <br /> approval, Lakewood plans to appropriate sufficient funds to meet the <br /> maximum amount that may be paid to the Transfer Station for 1994 and <br /> 1995. <br /> <br />5. Lakewood agrees to transport its refuse to the Transfer Station <br /> during normal work hours. Cleveland shall supply Lakewood with a <br /> schedule of the TranSfer Station's hours of operation. Included in <br /> the schedule shall be all the days in which the Transfer Station will <br /> be closed due to holidays or for any other reason. Also included in <br /> the schedule shall be alternate dumping sites, which are owned and <br /> operated in Cleveland, if the Transfer Station were to close due to <br /> unforeseen circumstances. <br /> <br />6. The alternative dumping sites shall operate under the same terms and <br /> conditions which apply to the Transfer Station as set forth in this <br /> Agreement. <br /> <br />7. The Transfer Station shall accept for disposal all types of ordinary <br /> residential and commercial refuse from Lakewood. If refuse is. not <br /> accepted by the Transfer Station, Cleveland shall provide Lakewood <br /> with a list of materials not accepted, reasons why such materials <br /> were not accepted, and offer alternative methods of disposal within <br /> Cleveland City limits. <br /> <br />7. After Lakewood delivers the refuse, Cleveland shall furnish all <br /> labor, tools, equipment, and power for the operation of the Transfer <br /> Station. <br /> <br />8. Lakewood does not guarantee the quantity, weight, or volume of refuse <br /> to be delivered to'the Transfer Station. <br /> <br />9. Ail invoices from Cleveland shalI be sent on a monthly basis to the <br /> Public Works Department of LakewOod. Lakewood shall pay Cleveland on <br /> a monthly basis. Invoices should include the date of delivery by <br /> Lakewood, the truck number which delivered the refuse, and the net <br /> weight of the refuse disposed of by Cleveland. <br /> <br /> <br />
