WHEREAS, Section 3 Article XVIII of the Constitution of the State of Ohio grants municipalities the authority to adopt land use and control measures for promoting the health, safety, and general welfare of its citizens; and WHEREAS, pursuant to such authority and with the purpose of participating in the National Flood Insurance Program (NFIP), ~he City adopted its Flood Damage Prevention Code on Januar~ 16, 1978; and WHEREAS, the NFIP modeI code has been ~mended since the City adopted its Flood Damage Prevention Code; and WHEREAS, the City's Flood Damage Prevention Code must remain in compliance with the NFIP model code in order to continue to participate in the NFIP; and WHEREAS, suspension from the NFIP.woul~ preyer owners of flood-prone property from securing flood insurance from the Federal EmergencY Management Agency, which administers the NFIP; now, ~herefore, 'BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Chapter 1308 of the Building Code of the Codified Ordinances of the City of Lakewood, Ohio, now reading as follows: CHAPTER 1308 FLOOD DAMAGE PREVENTION CODE 1308.01 TITLE. The provisions of this Chapter, hereinafter referred to 'as this "Code" shall be known as the. Flood Damage Prevention Code of the City of Lakewood. 1308.02 ' FINDINGS OF FACT. (b) These flood losses are caused by the cumulative effect of obstructions .in areas of special flood hazards which.increase flood heights and velocities and, when inadequately anchored, damage' uses in other areas. Uses that are inadequately floodproofed, elevated or otherwise protected from flood damage also contribute to the flood loss.
