(ii) the bottom of all openings shall~be <br /> no higher than one foot above grade. <br /> Openings may be equipped with <br /> screens, louvers, valves, or other <br /> openings provided that they permit <br /> the automatic entry and exit of <br /> floodwaters. <br /> <br />1308.20 AREAS WITH FLOODWAYS. <br /> <br />The Flood Insurance Study referenced in Section <br />1308.07 identifies a segment within areas of <br />special flood hazard known as a floodway. <br />Floodways may also be delineated in other sources <br />of flood information. The floodway is an extremely <br />hazardous area due to the velocity of flood waters <br />which carry debris, potential projectiles, and <br />erosion potential. The following provisions apply <br />within all delineated floodway areas: <br /> <br />(a) <br /> <br />Prohibit encroachments, including fill, new <br />construction, substential improvements, and <br />other development unless a h~drologic and <br />hydraulic analysis performed in accordance <br />with st~n~rd engineering practices <br />demonstrates that the proposed encroachment <br />would not result in any increase in flood <br />levels during the occurrence of the base flood <br />discharge. <br /> <br />(b) <br /> <br />If subsection (a) hereof is satisfied, all new <br />construction and substantial improvements <br />shall comply with all applicable flood hazard <br />reduction provisions of Section 1308.19, <br />Specific Standards. <br /> <br />(c) <br /> <br />any encroachment within the floodway that' <br />would result 4, an increase in base flood <br />elevations can only be granted upon the prior <br />approval b~ the Federal Rmergenc~ N~n~gement <br />Agency. Such requests must be submitted by <br />the Building Co ...... issioner to the Federal <br />Emergenc~ Management Agenc~ and must meet the <br />requirements of the National Flood Insurance <br />Program. <br /> <br />1308.99 PENALTY. <br /> <br />Whoever violates any provision of this Code or any <br />rule or regulation promulgated hereunder, or fails <br />to comply herewith or with any written notice or' <br />order issued hereunder is guilty of a misdemeanor <br />of the first degree. Each day such violation <br />occurs or continues to occur shall constitute a <br />separate offense. <br /> <br /> Section 2. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of ~his <br /> ordinance were adopted in an open meeting of this Council, and ~hat <br /> all such deliberations of this Council and of any of its committees <br />-that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br />26 <br /> <br /> <br />
