<br />, <br />ì <br /> <br />B. Eligible Borrower covenants to fully comply with all HOME Program <br />requirements and regulations which HUD or the Consortium may impose on Eligible Borrower <br />in order to pennit the Consortium to fully comply with its certifications and assurances to HUD. <br /> <br />C. Compliance by the Eligible Borrower shall include compliance with all <br />special requirements of the Consortium described herein and compliance with all HOME <br />Program requirements, based upon the applicable regulatory provisions which include, but are <br />not limited to, the following sections of the HOME Program: <br /> <br />i. Property Standards (§92.251); <br /> <br />11. Equal opportunity and fair housing (§92.350); <br /> <br />iii. Displacement, relocation and acquisition (§92.353); <br /> <br />iv. Lead-based paint (§92.355); <br /> <br />v. Conflict of interest (§92.356); <br /> <br />vi. Debannent and suspension (§92.357); and <br /> <br />vii. Flood insurance (§92.358) (The Eligible Borrower covenants that the <br />Project Site is not currently located in a designated flood prone or flood <br />risk area, however the Eligible Borrower agrees to maintain flood <br />insurance, in the event such insurance is required pursuant to a <br />designation of the area in which the Project Site is located as flood prone <br />or a flood risk area, as defmed by the Flood Disaster Protection Act of <br />1973, as amended). <br /> <br />D. Compliance by the Eligible Borrower shall further include: <br /> <br />i. Eligible Borrower Agreements. The Eligible Borrower hereby <br />agrees, to the extent applicable to the Eligible Borrower, that: <br /> <br />a. it shall not discriminate against any employee or applicant for <br />employment because of race, religion, color, sex, national origin, <br />disability or age and require all of its contractors and <br />subcontractors for any part of such work to incorporate such <br />requirement in all subcontracts for work perfonned àt the Project <br />Site; <br /> <br />b. it shall fully indemnify the Consortium and the City for any <br />costs reimbursed under this Agreement which are disallpwed by <br /> <br />6 <br />
