Eligible Borrower covenants to fully comply with all HOME Program requirements and regulations which HUD or the Consortium may impose on Eligible Borrower in order to pennit the Consortium to fully comply with its certifications and assurances to HUD. C. Compliance by the Eligible Borrower shall include compliance with all special requirements of the Consortium described herein and compliance with all HOME Program requirements, based upon the applicable regulatory provisions which include, but are not limited to, the following sections of the HOME Program: i. Property Standards (§92.251); 11. Equal opportunity and fair housing (§92.350); iii. Displacement, relocation and acquisition (§92.353); iv. Lead-based paint (§92.355); v. Conflict of interest (§92.356); vi. Debannent and suspension (§92.357); and vii. Flood insurance (§92.358) (The Eligible Borrower covenants that the Project Site is not currently located in a designated flood prone or flood risk area, however the Eligible Borrower agrees to maintain flood insurance, in the event such insurance is required pursuant to a designation of the area in which the Project Site is located as flood prone or a flood risk area, as defmed by the Flood Disaster Protection Act of 1973, as amended). D. Compliance by the Eligible Borrower shall further include: i. Eligible Borrower Agreements. The Eligible Borrower hereby agrees, to the extent applicable to the Eligible Borrower, that: a. it shall not discriminate against any employee or applicant for employment because of race, religion, color, sex, national origin, disability or age and require all of its contractors and subcontractors for any part of such work to incorporate such requirement in all subcontracts for work perfonned àt the Project Site; b. it shall fully indemnify the Consortium and the City for any costs reimbursed under this Agreement which are disallpwed by 6
