<br />( <br /> <br />( <br /> <br />documented by the Borrower and verified by the City. <br />Capital improvement investments as used in this section <br />shall mean the investments by the Eligible Borrower in any <br />capital assets, as such term is defined in the then applicable <br />Internal Revenue Code. <br /> <br />E. The Eligible Borrower certifies by executing this Agreement, that it is not <br />presently debarred, suspended, proposed for debarment, declared <br />ineligible, or voluntarily excluded from participation in this transaction by <br />any Federal department or agency. <br /> <br />F. The Eligible Borrower certifies that it will comply with the following anti- <br />lobbying provisions: <br /> <br />i. No federal appropriated funds have been or will be paid, by or on <br />behalf of the Eligible Borrower, to any person for the purpose of <br />influencing or attempting to influence an officer or employee of <br />any agency or a Member of Congress in connection with the <br />awarding of the Consortium HOME Loan, any Federal loan, the <br />entering into of any cooperative agreement, and the extension, <br />continuation, renewal, amendment, or modification of any Federal <br />contract, loan, loans, or cooperative agreement; <br /> <br />ii. If any funds other than Federal appropriated funds have been or <br />will be paid to any person for influencing or attempting to <br />influence any officer or employee of any agency, a Member of <br />Congress, an officer or employee of Congress, or any employee <br />of a Member of Congress in connection with this Agreement, then <br />such person will complete and submit Standard Form-LLL, <br />"Disclosure Form to Report Lobbying," in accordance with its <br />instructions . <br /> <br />SECTION 7. OTHER LONG-TERM OBLIGATIONS OF ELIGffiLE BORROWER. <br /> <br />A. The Eligible Borrower, and for its successors and assigns, agrees during <br />the term of this Agreement to keep all buildings and improvements on the Project Site insured <br />against loss by fire, wind storm and vandalism in an amount and on the terms satisfactory to the <br />City and the COnsortium; provided that the City shall be named as loss payee subordinate to the <br />Participating Banle <br /> <br />B. All activities engaged in by the Eligible Borrower in performing this <br />Agreement shall be conducted in compliance with all federal, state, and local laws, whether or <br />not otherwise referenced in this Agreement. <br /> <br />9 <br />
