<br />-- <br /> <br />,~, <br /> <br />ORDINANCE NO. 48-95 <br /> <br />BY: Flannery, George, Roth <br />Seelie, Smith <br /> <br />AN EMERGENCY ORDINANCE approving a collective bargaining agreement <br />with Local 382, International Association of Firefighters, AFL-CIO, establishing conditions of <br />employmellt, working conditions and various benefits for certain employees of the <br />Department of Public Safety of the City of Lakewood, and authorizing the Mayor to sign said <br />agreement on behaif of the City. <br /> <br />WHEREAS, a prior collective bargaining agreement entered into between the <br />City of Lakewood and Local 382, International Association of Firefighters, AFL-CIO, <br />terminated on December 31, 1994, and <br /> <br />WHËREAS, discussions and negotiations have been continued subsequently <br />on behalf of the City with representatives of Local 382, International Association of <br />Firefighters, AFL-CIO, with respect to conditions of employment, working conditions and <br />various benefits for certain employees of the Department of Public Safety of the City of <br />Lakewood, and <br /> <br />WHEREAS, an agreement has been reached in the course of said <br />discussions and negotiations with respect to the conditions of employment, working <br />conditions and various benefits for certain employees aforementioned, and <br /> <br />WHEREAS, this Council determines that it is in the best interest of the City to <br />approve said collective bargaining agreement and authorize the Mayor to sign same on <br />behalf of the City, and <br /> <br />WHEREAS, this Ordinance constitutes an emergency méasure providing for <br />the immediate preservation of th.e public health, safety and weifare, and for the usual daily <br />operation of a municipal department for the reason that it is necessary to approve said <br />agreement at the earliest possible time to insure high morale in the City's safety forces and to <br />maintain lawful and orderly iabor management relations; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br />Section 1. That the collective bargaining agreement with Local 382, <br />Intérnational Association of Firefighters, AFL-CIO, and effective for the period of January 1, <br />1995, to December 31, 1997, an original copy of which is on file in the Office of the Mayor of <br />the City of Lakewood and is made a part hereof as though written fully herein, is hereby <br />adopted, ratified and approved, and the Mayor is hereby authorized and directed for and on <br />behalf of the City of Lakewood to affix his signature hereto. <br /> <br />Section 2. That all other ordinances or resolutions or parts of ordinances or <br />resolutions whiCh are inconsistent with the provisions of this Ordinance and/or the collective <br />bargaining agreement madé a part hereof, are hereby repealed as of January 1, 1995, to the <br />extent that they pertain to the employees in the bargaining unit covered by the collective <br />bargaining agreement and are inconsistent with this Ordinance, including the collective <br />bargaining àgreement referred to herein and made a part thereof. <br /> <br />Section 3. It is found and détermined that all formal actions of this Council <br />concerning and relating to the passage of this Ordinance were adopted in an open meeting of <br />this Council and that all such deliberations of this Council and any of its committees that <br />
