AGREEMENT <br /> <br />Between the Board of County Commissioners of Cuyahoga County <br /> and the City of Lakewood <br />for the resurfacing and replacement of expansion joints on <br />Hilliard Boulevard (CR-69) Bridge No. 65 over the Rocky River <br /> <br /> This agreement entered into at Cleveland, Ohio this g~ day of <br /> ~~y , 19 ~?, by and between the County of Cuyahoga, Ohio, by <br />its Board/of County C-~-mmissioners, Party of the First Part and hereinafter <br />referred to as the COUNTY and the City of Lakewood by its Mayor, having <br />been duly authorized to enter into said agreement by Ordinance No. <br /> 7-96 adopted by Council of the City of Lakewood on the 6th day of <br /> May , 19_~_~, Party of the Second Part a'nd hereinafter referred to <br />as tSe MUNICIPALITY. <br /> <br />WITNESSETH: <br /> <br /> WHEREAS, the MUNICIPALITY has recognized the need for and proposes <br />the improvement of a portion of public highway which is described as <br />follows: <br /> <br />The resurfacing and rePlacement of expansion joints on Hilliard <br />Boulevard (CR-69) Bridge No. 65 over the Rocky River. <br /> <br /> WHEREAS, this project is part of a larger project which involves two <br />Cities, Lakewood and Rocky River. <br /> <br /> NOW THEREFORE, in consideration of the covenants and agreements <br />herein contained to be performed by the parties hereto, it is mutually <br />agreed between the parties hereto as follows: <br /> <br />A. CONSENT <br /> <br />That it is declared to be in the public interest that the consent <br />of said MUNICIPALITY be and such consent is hereby given to the <br />COUNTY and the Ohio Department of Transportation tO construct the <br />above described improvement in accordance with plans, <br />specifications and estimates approved by the COUNTY. <br /> <br />Bo <br /> <br />COOPERATION <br /> <br />1. ~That the MUNICIPALITY will cooperate with~ the COUNTY and the Ohio <br /> Department of Transportation in the resurfacing and the <br /> replacement of expansion joints on Hilliard Boulevard (CR-69) <br /> Bridge No. 65 over the Rocky River. <br /> <br />That the COUNTY will arrange for the preparation of construction <br />plans and specifications, including necessary engineering reports <br />for improvements, under current Cuyahoga County Engineer <br />standards for construction of County roads and bridges. <br /> <br />3. That the County will arrange for the supervision and <br /> administration of the construction contract. <br /> <br /> <br />
