PLACED ON 1st READING ~ R~FERRI~D TO THE <br />PUBLIC WORKS CO~ITTEE ON 10/7/96. <br /> <br />PLACED ON Znd READING ON 10/21/96. <br /> <br />ORDINANCE NO. 37-96 <br /> <br />BY: <br /> <br />Boscia, Corrigan, Flannery, <br />George, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE establishing a Division of Winterhurst <br />within the Department of Public Works to provide for the management, <br />operation, maintenance, and improvements for Winterhurst Ice Rink. <br /> <br /> WHEREAS, the Council shall by Ordinance provide for the <br />organization of the Public Works Department and <br /> <br /> WHEREAS, Council shall have the power to establish, by Ordinance, <br />additional Divisions as the public service may require and <br /> <br /> WHEREAS, the City owns the Winterhurst Ice Rink, a recreational <br />facility offering ice skating facilities to groups and individuals, and <br /> <br /> WHEREAS, the Lakewood Board of Education as of June 30, 1996, no <br />longer manages the Winterhurst Ice Rink and <br /> <br /> WHEREAS, the City of Lakewood has managed and operated the <br />Winterhurst Ice Rink on an interim basis as of July 1, 1996~. and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department for the reason that <br />implementing more effective management procedures is necessary to protect the <br />valuable municipal asset, now therefore, <br /> <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That a Division of Winterhurst be established within <br />the Department of Public Works to manage, operate, maintain, and improve the <br />Winterhurst Ice Rink. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this Ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and any of its committees that resulted in such formal action <br />were in meetings open'to the public in compliance with all legal requirements. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives an affirmative vote of two-thirds of all members elected to <br />Council, it shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise, shall take effect and be in force after <br />the earliest period allowed by law. <br /> <br /> President <br /> <br />Clerk <br /> <br /> <br />
