PLACED ON 1ST READING ~ REFERRED TO THE <br />PUBLIC WORKS COMMITTEE ON 10/7/96. <br /> <br />PLACED ON 2nd READING ON 10/21/96. <br /> <br />ORDINANCE NO. 38-96 <br /> <br />Boscia, Corrigan, Flannery, <br /> George, Roth, Seelie, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />(Director of Public Safety), the Director of Public Works, and the Director of <br />Finance to solicit for Requests for Proposals to enter into a contract with <br />the best respondent in accordance with the Codified Ordinances of the City of <br />Lakewood for the Development of a Comprehensive Business Plan to include <br />financial management, marketing, operations and maintenance, and capital <br />improvements for Winterhurst Ice Rink. <br /> <br /> WHEREAS, an emergency exists to provide for the immediate <br />preservation of the public property, health and safety, and to provide for the <br />usual daily operation of municipal departments in that special expertise in <br />the management, operation and maintenance of ice rinks exists and could <br />benefit Winterhurst Ice Rink, its customers, and the City of Lakewood, and <br /> <br /> WHEREAS, the City of Lakewood assumed the management and operation <br />of Winterhurst Ice Rink on an interim basis as of July 1, 1996, and <br /> <br /> WHEREAS, it is the recommendation that a Division of Winterhurst <br />be created within the Department of Public Works, and <br /> <br /> WHEREAS, the development of a comprehensive business plan is <br />necessary for the survival of Winterhurst Ice Rink, and <br /> <br /> WHEREAS, the City of Lakewood would benefit from consulting <br />expertise from qualified respondents in all the aspects of ice rink <br />management, now therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the Mayor (Director of Public Safety), the <br />Director of Public Works, and the Director of Finance are hereby authorized <br />and directed to solicit Requests for Proposals and enter into a contract with <br />the best respondent in accordance with the Administrative Code of the City of <br />Lakewood for the Development of a Comprehensive Business Plan to include <br />financial management, marketing, operations and maintenance, and capital <br />improvements for Winterhurst Ice Rink. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this Ordinance were <br />adopted in an open meeting of this Council, and that all such deliberations of <br />this Council and any of its committees that resulted in such formal action <br />were in meetings open to the public in compliance with all legal requirements. <br /> <br /> Section 3. That this Ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and provided <br />it receives an affirmative vote of two-thirds of alt members elected to <br />Council, it. shall take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise, shall take effect and be in force after <br />the earliest period allowed by law. <br /> <br />President <br /> <br /> <br />
