17q3.07 TATTOOING DISI-'.ASI'TD IN"I'f)XICATED <br /> <br />MINORS. <br /> <br />(A) <br /> <br />It shall bc unlawful to tattoo any person who is known to have, or who sho~s <br />signs of having any communicable disease or any disease of the skin, <br />including rashes, pimples, boils, infections or any manifestation or evidencc <br />of unhealthy conditions. <br /> <br />It shall be unlawful to tattoo any individual under the influence of alcohol <br />and/or any narcotic drug or drug of abuse. <br /> <br />(C) It shall be unlawful for any tattoo operator to be under the influence of <br /> alcohol and/or narcotic drug or drug of abuse when tattooing. <br /> <br />(D) <br /> <br />it shall be unlawful to tattoo any individual who is under twenty-one (21 ) <br />years of age, regardless of whether the operator knows this person to be less <br />than twenty-one (21') years of age, or the operator is reckless in that regards. <br /> <br />(E) <br /> <br />Whoever violates this section is guilty ora misdemeanor of the first de~ee. <br />This Section shall be enforced by the Director of Public Safety or designee, <br />the Division of Police, or any public health official. <br /> <br />1793.99 PENALTY. <br /> <br />(A) The Division of Health may suspend or revoke a Tattoo Establishment <br /> license for violation of this regulation. <br /> <br />The provisions of this Chapter shall apply to all tattoo establishments and/or <br />tattoo operators which are currently in existence, or which may come into <br />existence after the effective date of this Chapter. The provisions of this <br />Chapter shall NOT apply to a Physician licensed to practice medicine in the <br />State of Ohio who is tattooing for a medical purpose. <br /> <br />(c) <br /> <br />In the event of conflict between any provisions of this Chapter or the Ohio <br />Revised Code, including any rules and regulations adopted pursuant to this <br />Chapter or the Ohio Revised Code, and any provisions of City ordinances, <br />including any rules and regulations adopted pursuant to such ordinances, that <br />provision or ordinance which establishes the higher standard for the <br />promotion or protection of the health or safety of the people shall govern. <br /> <br />(D) <br /> <br />Whoever violates this regulation shall be subject to the penalties of Ohio <br />Revised Code 3709.99 or Ohio Revised Code 3707.02, unless otherwise <br />specified in this Chapter. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this ordinance were adopted in an open meeting <br />of this council, and that all such deliberations of this Council and any of/ts committees <br />that resulted in such formal actions, were in meetings open to the public, in compliance <br />with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency measure t'or <br />the masons stated in the preamble hereof and provided it receives the affirmative vote of <br />two~thirds of alt members elected to Council, it shall take effect and be in frbrce <br />immediately upon its adoption and approval by the Mayor: otherwise, it shall take effcct <br />and be in l'brce after the earliest period allowed by law. <br /> <br />Presidc, c,,,~ /7 / / . _ <br /> <br /> <br />
