All compensation provided for herein shall be paid in equal installments every two (2) weeks. Section 3. All annual salaried employees shall be entitled to compensable time off for actual hours worked in excess of eight (8) hours per day and forty (40) hours per week, and for work performed on Saturday, Sunday and any holiday as defined in Section 149.10, provided herein that no accrued compensatory time shall be converted to cash upon termination of employment. In lieu of the compensable time authorized herein, all annual salaried employees covered under the provisions of the Fair Labor Standards Act shall be paid time and one-half their regular pay for all hours worked in excess of forty (40) hours per week. This Section does not apply to Traffic Signal Technicians - Department of Public Works, whose overtime compensation is covered pursuant to Section 5 and Section 6 herein, or employees who are paid overtime pursuant to a collective bargaining agreement. Section 4. Traffic Signal Technicians. shall receive time and one-half of their regular pay for all hours worked in excess of eight (8) hours per day and forty (40) hours per week. Traffic Signal Technicians shall receive time and one-half for all hours worked on Saturday, Sunday or any holiday as defined in Section 149.10. Section 5. Traffic Signal Technicians - Department of Public Works, who work more than four (4) hours as part of a regular shift assignment between the hours of 3:30 p.m. and 8:30 a.m. shall receive a shift premium of twenty five cents ($.25) per hour for all hours worked during the second shift (3:30 p.m. to 12:00 midnight) and thirty cents ($.30) per hour for all hours worked during the third shift (12:01 a.m. to 8:30 a.m.). Section 6. A qualified physician who is appointed to serve part-time as the City's Health Commissioner shall be entitled to receive wages of $15,218 per year. Section 7. Employee members, while serving upon a jury in any court, shall be paid at his regular salary rate for each of his workdays during the period of time so served. Time so served shall be deemed active and continuous service for all purposes. In addition to the compensation provided for herein, .any jury fees paid to the employee/juror for service in any court, except Lakewood Municipal Court, shah be retained by the employee to compensate for the expenses of jury service. Section 8. It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in SUch formal action were in meetings open to the public, in compliance with all legal requirements. Section 9. That this Ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the ~qrmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by
