PLEASE SUBSTITUTE FOR ORDINANCE No. 77-97 PLACED O× lsr Reading ~ Referred TO <br />FINANCE C03[x'[ITTEE ON 6/2/97; PLACED ON 2nd Reading O× 6/16/97. <br /> <br /> ORDINANCE NO, 27-97 BY: <br /> <br /> AN EMERGENCY ORDINANCE enacting new Section 129.37 of <br />the Administrative Code of the Codified Ordinances of the City of <br />Lakewood to establish a Helmet Safety Special Revenue Fund and <br />authorizing the Director of Finance, on behalf of the City, to accept and <br />expend grant funds awarded by Rite Aid for the purpose of purchasing <br />bike helmets. <br /> <br /> WHEREAS, Lakewood CiD/ Council passed Ordinance #29-96 <br />requiring children and teens under the age of 18 to wear a helmet <br />while riding a bicycle, rollerblades or a skateboard and directed that a <br />helmet bank be established for collection of fines from violations of <br />the Ordinance and donations; and <br /> <br /> WHEREAS, the Ci~/has been awarded a grant from Rite Aid <br />in the amount of $2,500 for the purpose of providing bike helmets for <br />the community; and <br /> <br />WHEREAS, there is a compelling governmental interest tO <br />establish a new Special Revenue Fund to monitor the expenditure of <br />these funds; now, therefore, <br /> <br /> BE IT ORDAINED 8Y THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Administrative Code of the City of <br />Lakewood is hereby supplemented by enacting new Section 129.37 <br />thereof 1:o read as follows: <br /> <br />129.37 <br /> <br />Helmet Safety Fund <br /> <br />a.) All revenues derived from grants, donations or <br />fines pertaining to Helmet Safety shall be kept and <br />maintained in a separate fund hereby designated as <br />the Helmet Safety Fund. All revenues and expenses <br />pertaining to the purchase and distribution of bike <br />helmets shall be from this fund. <br /> <br /> Section 2. That the Director of Finance is hereby authorized <br />and directed to take the necessary steps to establish said account; to <br />receive and administer funds and to make expenditures from said <br />account for the above described purposes. <br /> <br /> Section 3.
