ORDINANCE NO. 43-97 BY: Corrigan, Flannery, George Roth, Seelie, Smith AN EMERGENCY ORDINANCE authorizing and directing the Director of Public Works, the Director of Law, Director of Finance and/or the Procurement Officer to buy through a negotiated purchase; one, new, Jeep Wrangler Sport, 4 W.D. with snowplow. WHEREAS, an emergency exists to provide for the immediate preservation of the public property, health and safety and tO provide for the usual daily operation of municipal departments; and, WHEREAS, it is in the best interest of the City to buy this vehicle through a negotiated purchase, and Whereas, Council has the authority under Codified Ordinance 111.04(a)(10) to approve a form of the contract to be awarded without competitive bidding; now, therefore, BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Finance be and she is hereby authorized and directed to buy through a negotiated purchase one, new, Jeep Wrangler Sport, 4 W.D. with snowplow. Section 2. [t is found and determined that all formal sections of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public in compliance with all legal requirements. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons set forth in the preamble hereof and provided it receives the affirmative vote of two- thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law. ~~President / v ',~ayor
