PLEASE SUBSTITUTE FOR ORDINANCE <br />NO. 68-97 PLACED ON 1ST READING & <br />REFERRED to HOUSING COMMITTEE 12/15/97 <br />2ND READING ON 2/17/98. <br />Amended on floor 4/20/98. <br /> <br />ORDINANCE NO. 68-97 BY: Corrigan, Flannery, George, <br /> Roth, Seelie, Skindei1, Smith <br /> <br /> AN ORDINANCE repealing Chapter 1303, The Regional Building Code, and Chapter <br />1305, The Lakewood Housing Code, and enacting new Chapter 1306, The l. akewood Propedy <br />Maintenance and Safety Code of the Building Code of the Lakewood Codified Ordinances. <br /> <br /> WHEREAS. ChapTer 1303, The Regional Building Code, is obsolete, having been <br />superseded by the State of Ohio Basic Building Code (O.B.B.C.); and <br /> <br /> WHEREAS Chapter 1305, The Lakewood Housing Code, has served the City well for <br />many years, with minor amendments in 1980 and 1992. a new building code is needed to meet <br />existing conditions; and <br /> <br /> WHEREAS, proposed Chapter 1306, The Lakewood Property Maintenance and Safety <br />Code, will serve the current and future needs of the City by establishing a standard to make all <br />homes and buildings safe, sanitary, free from fire and health hazards, and beneficial to the <br />public welfare; now, therefore, <br /> <br />BE IT ORDAINED E~Y THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That Chapter 1303 of the Building Code of the Lakewood Codified Ordinances <br />shall be and the same is hereby repealed. <br /> <br /> Section 2. That Chapter 1305 of the Building Code of the Lakewood Codified Ordinances <br />shall be and the same is hereby repealed. <br /> <br /> Section 3. That the Building Code of the Lakewood Codified Ordinances is hereby <br />supplemented by enacting new Chapter 1306 The LakeWood Property Maintenance and Safety <br />Code, to read as follows: <br /> <br /> 1306.01 TITLE. <br /> The prowsions of this chapter hereinafter referred to as "this Code," shall be known as the <br />~'he Lakewood Property Maintenance and Safety Code". <br /> <br /> 1306.02 PURPOSE. <br /> Within the scope of this Code as hereinafter defined, the purpose of this Code is to <br />establish minimum standards necessary to make all dwelling and occupiable structures safe, <br />sanitary, free from fire and health hazards and fit for human habitation and beneficial to the <br />public welfare; to establish minimum standards governing the maintenance of dwellings, <br />occupiable structures and exterior property areas in such condition as will not constitute a <br />~blighting or deteriorating influence on the neighborhood and the community; to ~3rotect property <br />values and to maintain the character and appearance of the community ancl neighborhoods <br />within the community; to fix responsibilities for owners and occupants of structures with respect <br />to sanitation, repair and maintenance; to establish additional standards for rental dwellings; to <br />authorize the inspection of structures; to establish enforcement procedures; to authorize the <br />vacation or condemnation of structures unsafe or unfit for human habitation and to fix penalties <br />for violations. <br /> <br /> 1306.03 GENERAL SCOPE. <br /> The provisions of this Code shall supplement any and all laws of the State of Ohio and <br />City ordinances, and specifically shall include all rules and regulations promulgated by authority <br />of such laws or ordinances applicable to buildings and other structures. <br /> <br /> 1306.04 APPLICATION. <br /> (a) This Code shall apply to all buildings and other structures or portions thereof whi~ch <br />are used, designed or intended to be used for dwellings, dwelling units, structures or occupiable <br />structures. <br /> <br /> (b) Existing buildings may continue to be occupied for dwellings, dwelling units or <br />occupiable structures if: <br /> <br /> <br />
