(c) Except in emergency situations, no penalty under the penalty provisions of this Code <br />shall apply against any owner who refuses the right of entry hereunder until a search warrant is <br />obtained. <br /> <br /> 1306.51 RESPONSIBILITY FOR COMPLIANCE. <br /> The owner as defined in this Code shall be responsible for compliance with all of the <br />provisions of this Code except where the responsibility therefor is specifically placed elsewhere. <br /> <br /> 1306.52 REPAIR OF CODE VIOLATIONS. <br /> (a) Examination by Buildinq Commissioner. The Building Commissioner shall examine <br />or cause to be examined every dwelling structure, occupiable structure, appurtenant structure <br />and/or premises reported to be in violation of any of the provisions of the Code and shall make <br />a wdtten record of such examination. <br /> <br /> (b) Notice of Violation and Order tO Repair to Owner or Person in Control. Whenever <br />the Building Commissioner determines that any dwelling structure, occupiable structure, <br />appurtenant structure and/or premises is in violation of any of the provisions of this Code, but <br />that such violations do not result in such structure or premises being a public nuisance, he shall <br />give wdtten notice of violation and order to repair to the owner or person in control thereof. <br /> <br /> (c) Contents of Notice of Violation and Order to Repair. Such wdtten notice of violation <br />and order to repair shall specify the structures and/or premises deemed to be in violation of this <br />Code, shatl specify which section or sections of this Code are being violated, shall include an <br />order to repair defects therein or thereon to allow the owner or person in control to make <br />required repairs, and shall specify a reasonable pedod of time and/or date by which such <br />repairs shall be completed so as to bdng such structures and/or premises into conformity with <br />this Code. <br /> <br /> (d) Service of Notice and Order. Whenever the Building Commissioner finds any <br />dwelling structure, occupiable structure or premises, or any part thereof, to be in violation of the <br />provisions of this Code, the Building Commissioner shall give or cause to be given or mailed to <br />the owner or person in control of such structure or premises a wdtten notice stating the <br />violations therein. Such notice shall order the owner or person in control within a stated <br />reasonable time to repair, improve or demolish the structure or premises concerned. Such <br />delivery or mailing shall be deemed legal service of notice. <br /> <br /> If the person to whom a notice of violation is addressed cannot be found within Cuyahoga <br />County after reasonable and diligent search, then notice may be sent by certified mail to the last <br />known address of such person, and a copy of such notice shall be posted in a conspicuous <br />place on the structure or premises to which it relates. Such mailing and posting shall be <br />deemed legal service of notice. <br /> <br /> (e) Duty to Inform Purchaser. It shall be the duty of any owner or person in control of <br />such structures and/or premises who has received a notice of violation and order to repair to <br />inform any purchaser thereof of such notice and order. No owner or person in control of such <br />structures and/or premises shall transfer to any vendee any interest in such structures and/or <br />premises after receiving such notice and order without first providing the vendee with a copy of <br />such notice and order. <br /> <br /> 1306.521 REPAIR OR DEMOLITION OF UNSAFE STRUCTURES. <br /> (a) Nuisance. All dwelling structures, occupiable structures and appurtenant structures <br />which are a menace to the public health, safety or welfare or which are structurally unsafe or <br />unsanitary, or are not provided with adequate safe egress, or which constitute a fire hazard or <br />are otherwise dangerous to human life, or which in relation to existing use constitute a hazard <br />to the public health, safety or welfare by reason of inadequate maintenance, dilapidation, <br />obsolescence, or abandonment are, severally, for the purposes of this section, declared to be <br />unsafe structures or public nuisances. All such unsafe structures are hereby declared to be <br />illegal and shall be abated by repair and rehabilitation or by demolition in accordance with the <br />procedures of this section. <br /> <br /> (b) Notice of Nuisance and Order to Repair or Demolish. Whenever the Building <br />Commissioner determines any dwelling structure, occupiable structure or appurtenant structure <br /> <br /> <br />
