PLACED ON 1ST READING & REFERRED TO FINANCE CMTE 2/2/9~ <br />2nd Reading 2/17/9?~ <br /> <br />ORDFNANCE NO. 21-98 BY: Corrigan, Flannery, George, <br /> Roth, Seelie, Skindell, Smith <br /> <br /> AN EMERGENCY ORDINANCE to regulate the maximum assessment on <br />property owners for improvement of Clifton Road and Forest Road in the City of <br />Lakewood. <br /> <br /> WHEREAS, Council declared it necessary through Resolution No. 7090-95-A to <br />improve Clifton Road and Forest Road by removal where necessary, of the existing <br />surface course, by grading and replacement, where necessary, of the base and by <br />resurfacing with concrete, including the necessary replacement and reset~g of castings <br />together with necessary appurtenances thereto, and by replacing the sidewalk, curb and <br />driveway apron where necessary; and <br /> <br /> WHEREAS, Council determined to proceed with the improvements as specified <br />in Resolution No. 7090-95-A by adopting Ordinance No. 37-97; and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety and welfare, and for the usual daily <br />operation of a municipal department and for the further reason that the improvements <br />herein provided are immediately necessary to eliminate existing hazards to vehicular <br />traffic; now, therefor, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That notwithstanding any prior legislation, the maximum <br />assessment on property owners for the improvement of Clifton Road and Forest Road in <br />the City of Lakewood shall not exceed twenty (20%) percent of the engineer's original <br />estimate. <br /> <br /> Section 2. It is found and determined that all formal actions of this Council <br />concerning and relating to the passage to the passage of this ordinance were adopted in an <br />open meeting of this Council, and that all such deliberations of this Council and of any of <br />its committees that resulted in such formal action were in meetings open to the public in <br />compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency measure <br />for the re~sons stated in the preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall take effect and be in force <br />immediately upon its adoption and approval by the Mayor;, otherwise, it shall take effect <br />and be in force after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />President <br /> <br />Approved: <br /> <br />Clerk <br /> <br /> <br />
