ORDFNANCENO. 22-98 BY: Corrigan, Flannery, George, Roth, Seelie, Skindell, Smith AN EMERGENCY ORDINANCE authorizing and directing the Director of Public Works to enter into an agreement with an energy management company to perform capital modification and long-term maintenance work for the Winterhurst Energy Conservation and Renovation Program. WHEREAS, this program will involve a complete modernization and rehabilitation of the mechanical and electrical systems at Winterhurst Ice Rink, including the replacement of the ice surface chillers, the heating and ventilating equipment, light fixtures, and the instillation of an energy management system; and WHEREAS, additional modifications will move the ice chilling equipment to a separate building, replace the ceiling panels in the front lobby and on both levels of the facility, replace the locker room doo~s, and provide space for a female locker room; further, the program will provide a ten (10) year continuing maintenance agreement for all of the building systems; and WHEREAS, this program will result in a substantial reduction in the cost of electricity and natural gas used to heat and light the building, while improving the aesthetics of the facility; and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, welfare and safety and for the continued operation of the Winterhurst Ice Rink; now, therefore BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Director of Public Works is hereby authorized and directed, upon the review of competitive proposals, to enter into a contract with an energy management company in an amount not to exceed $1.3 million dollars to perform capital modifications and provide long-term maintenance for the Winterhurst Energy Conservation and Renovation Program. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 3. This ordinance is hereby declared an emergency measure for the reasons stated in the preamble hereof and provided it receives the a/~rmative vote of two- thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor;, otherwise, it shall take effect and be in force after the earliest period allowed by law.
