Section 20. That existing Section 1153.02(6) of the Codified O antes of the City of <br />Lakewood, now reading respectively as follows; <br />1153.02 REGULATIONS <br />(b) On a comer lot, no fence, shall be erected or placed on the side lot line adjacent to the <br />side street and extending from the rear property line to the building line except upon a <br />determination by the Commissioner that such fence, does not obstruct the view of vehicle <br />or pedestrian traffic, or constitute a hazard. <br />shall be and the same is hereby amended to read as follows: <br />1153.02 REGULATIONS <br />(b) On a comer lot, no fence, or living fence greater than thirty-six (36) inches above grade, <br />shall be erected or placed on the side lot line adjacent to the side street and extending <br />from the rear property line to the front building line or part thereof, except upon a <br />determination by the Commissioner that such fence or living fence does not obstruct the <br />view of vehicle or pedestrian traffic, or constitute a hazard. <br />Section 21. That existing Section 1153.02(d)(1) of the Codified Ordinances of the City of <br />Lakewood, now reading respectively as follows: <br />1153.02 REGULATIONS <br />(d) .... <br />(1) the fence shall be less than or equal to forty-two (42) inches above grade; a pole <br />less than or equal to ninety-six (96) inches above grade may be included in such <br />fence where such pole is used for lighting; <br />shall be and the same is hereby amended to read as follows: <br />(d) .... <br />(1) the fence shall be less than or equal to forty-two (42) inches above grade; a pole <br />less than or equal to ninety-six (96) inches above grade may be included in such <br />fence where such pole is used for lighting, address or a combination of both; <br />Section 22. Thai the existing Section 1153.02 of the Codified Ordinances of the City of <br />Lakewood be amended by enactment of new subsections (i) and (j) to read as follows: <br />1153.02 REGULATIONS <br />(i) A fence shall be placed entirely within the property line of its respective parcel. <br />(j) Wireless telecommunication facilities as regulated by Section 1159.05(1)(1). <br />Section 23. That the existing Section 1155.04 of the Codified Ordinances of the City of <br />Lakewood be amended by enactment of new sub-section (f) to read as follows: <br />~ 1155.04 PROCEDURES FOR MINOR SUBDIVISIONS <br />_ (f) Notice Procedure. Where a minor subdivision is requested, notice of the public hearing <br />held pursuant to Section 1171.03(f) shall be made in a newspaper of general circulation no <br />less than seven (7) days before the hearing; said notice shall state the time and place of the <br />hearing. <br />(1) In addition, notice, indicating the time, place, and subject of the hearing, shall be <br />sent by regular mail to the owners of: <br />(A) all properties abutting the subject property; <br />(B) all properties abutting such properties described in subparagraph (A) herein, <br />excepting properties located across the right-of-way from or behind said <br />abutting properties; <br />(Q any other property the Director deems affected by the proposed subdivision. <br />
