ORDINANCE NO: 30-98 BY: Corrigan, Flannery, George, <br /> Roth, Seelie, Skindell, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor of the City of <br />Lakewood, Ohio, to enter into a ¢onu'act with the Local 1043 and Ohio Council 8, <br />American Federation of State, County and Municipal Employees. <br /> <br /> WHEREAS, Council and the Administration have conducted extensive <br />negotiations with Local 10~3 and Ohio Council 8, American Federation of State, County <br />and Municipal Employees as the bargaining representative for members of the Public <br />Works Department; and <br /> <br /> WHEREAS, such negotiations have provided a Tentative Agreement between the <br />parties for the years 1998, 1999 and 2000; and <br /> <br /> WHEREAS, Council and the Administration have reviewed such proposal and do <br />desire to ratify and adopt such agreement; and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety and welfare, and for the usual daily <br />operation of municipal services; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1: That the Mayor be and is hereby authorized and directed to enter <br />into an Agreement with Local 1043 and Ohio Council 8, American Federation of State, <br />County and Municipal Employees, on behalf of members of the Public Works <br />Department, on the terms and conditions, contained in the Agreement, which is made a <br />pan bereof as though fully rewritten herein, a copy of which is on file in the Office of the <br />Director of Law, and as approved by the Director of Law. <br /> <br /> Section 2: It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this Ordinance were passed in an open meeting <br />of this Council and that all deliberations of this Council and any of its committees that <br />resulted in such actions were in meetings open to the public and in compliance with legal <br />Requirements. <br /> <br /> Section 3: That any, and all ordinances in conflict with the express provisions <br />of this Agreement are superseded by this Agreement. <br /> <br /> Section 4: That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of ali members, elected to Council, it shall take effect and <br />be in force immediately upon its adoption and approval by the Mayor;, otherwise, it shall <br />take effect and be in force aider the earliest period allowed by law. <br /> <br />Adopted:f~ck~' / /f~('; <br /> <br />President <br /> <br />Clet:k <br /> <br /> <br />
