0RDINANCE NO: 32=98 <br /> <br />BY: Corrigan, Flannery, George, <br /> Roth, Seelie, Skindell, Smith <br /> <br /> AN ElVlERGENCY ORDINANCE ratifying the Mayor's execution of Agreement <br />for the Settlement of Surface Tramsportation Board Finance Docket No. 33388 entitled <br />"Proposed Conrail Acquisition." <br /> <br /> WHEREAS, the City Administration and Council are of the opinion that the <br />settlement of Surface Tramportation Board Finance Docket No. 33388 as set forth in <br />Exhibit "A' attached hereto is in the best interest of the City; now, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1: That the Mayor's execution of the Memorandum of Agre~e_me~ t~J~~ <br />attached hereto as Exhibit "A" is hereby ratified. -~~.... <br /> <br /> Section 2: It i~ found and determined that all formal actions of this Council <br />concerning and relating to the passage of this Ordinance were adopted in an open meeting <br />of this Council and that all such deliberations of this Council and any of its committees <br />that resulted in such formal actions were in meetings open to the public and in <br />compliance with legal Requirements. <br /> <br /> Section 3: That this Ordinance 'is hereby declared to be an emergency <br />measure for the reason~ stated in the preamble hereof and provided it receives the <br />affirmative vote of two-thirds of all member~ elected to Council, it shall take effect and <br />be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall <br />take effect and be in force alter the earliest period allowed by law. <br /> <br />President <br /> <br />Approved~('I'~ <br /> <br />Clerk <br /> <br /> <br />
