ORDINANCE NO: 41-98 <br /> <br />BY: Corrigan, Flannery, George, <br /> Rot~-~ Seelie, Skindell, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor of the City of <br />Lakewoo& Ohio, to enter into a contract with the Fraternal Order of Police, Westem <br />Cuyahoga Lodge No. 25, Lakewood Division. <br /> <br /> WHEREAS, Council and the Admin/stration have conducted extensive <br />negotiations with the Fraternal Order of Police, Western Cuyahoga Lodge No. 25 as the <br />bargaining representative for members of the Division of Police; and <br /> <br /> WHERE., such negotiations have provided a Tentative Agreement between the <br />parties for the years 1998, 1999 and 2000; and <br /> <br /> WHEREAS, Council and the Administration have reviewed such proposal and do <br />desire to ratify and adopt such agreement; and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public healtk, safety and welfare, and for the usual daily <br />operation of municipal services; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1: That the Mayor be and is hereby authorized and directed to enter <br />into an Agreement with the Fraternal Order of Police, Western Cuyahoga Lodge No. 25, <br />on behalf of m~mbers of the Division of Police, on the terms and conditions, contained in <br />the Agreement, which is made a part hereof as though fully rewritten herein, a copy of <br />which is on file in the Office of the Director of Law, and as approved by the Director of <br />Law. <br /> <br /> Section 2: It is found and detained that all formal actions of this Council <br />concc~ming and relating to the passage of this Ordinance were passed in an open meeting <br />of this Council and that all deh'berations of this Council and any of its committees that <br />resulted in such actions were in me,~ing~ open to the public and in compliance with legal <br />Reguirements. <br /> <br /> Section 3: That any and all ordinances in conflict with the express provisions <br />of this Agreement are superseded by this Agreement. <br /> <br /> Section 4: That this Ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it receives the <br />affn-mative vote of two-thirds of all members elected to Council, it shall take effect and <br />be in force immediately upon its adoption and approval by the Mayor;, otherwise, it shall <br />take effect and be in force atter the earliest period allowed by law. <br /> <br />AdoPted: ~ ~5 /4~'aw <br /> <br />President <br /> <br />Clerk <br /> <br />~/.MMayor ~- <br /> <br /> <br />
