ORDINANCE NO. 42-98 <br />BY: Corrigan, Flannery, George, Roth, Seelie, Smith, Skindell <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor of the City of Lakewood, <br />Ohio, to enter into a contract with the Ohio Fratemat Order of Police, Ohio Labor Council, <br />Inc. on behalf of the Corrections Officers. <br /> <br /> WHEREAS, Council and the Administration have conducted extensive negotiations <br />with the Ohio Fraternal Order of Police, Ohio Labor Council, Inc., as the bargaining <br />representative for Correction Officer members of the Division of Police; and <br /> <br /> WHEREAS, such negotiations have provided a Tentative Agreement between the <br />parties for the years 1998, 1999 and 2000; and <br /> <br /> WHEREAS, Council and the Administration have reviewed such proposal and do <br />desire to ratify and adopt such agreement; and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety and welfare, and for the usual daily <br />operation of municipal services; now, therefore <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1: That the Mayor be and is hereby authorized and directed to enter into <br />an Agreement the Ohio Fraternal Order of Police, Ohio Labor Council, Inc. on behalf of the <br />Corrections Officers, Division of Police, on the terms and conditions, contained in the <br />Agreement, which is made a part hereof as though fully rewritten herein, a copy of which is <br />on file in the Office of the Director of Law, and as approved by the Director of Law. <br /> <br /> Section 2: It is found and determined that all formal actions of this Council <br />concerning and relating to the passage of this Ordinance were passed in an open meeting of <br />this Council and that all deliberations of ~ Council and any of its committees that resulted <br />in such actions were in meetings open to the public and in compliance with legal <br />Requirements. <br /> <br /> Section 3: That any and all ordinances in conflict with the express provisions of <br />this Agreement are superseded by this Agreement. <br /> <br /> Section 4: That this Ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and provided it receives the affirmative vote of <br />two-thirds of all members elected to Council, it shah take effect and be in force immediately <br />upon its adoption and approval by the Mayor;, otherwise, it shall take effect and be in force <br />after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />President <br /> <br />Appmved.'~~ 2 ~ ! <br /> <br /> <br />
