ORDINANCE NO. 42-98 BY: Corrigan, Flannery, George, Roth, Seelie, Smith, Skindell AN EMERGENCY ORDINANCE authorizing the Mayor of the City of Lakewood, Ohio, to enter into a contract with the Ohio Fratemat Order of Police, Ohio Labor Council, Inc. on behalf of the Corrections Officers. WHEREAS, Council and the Administration have conducted extensive negotiations with the Ohio Fraternal Order of Police, Ohio Labor Council, Inc., as the bargaining representative for Correction Officer members of the Division of Police; and WHEREAS, such negotiations have provided a Tentative Agreement between the parties for the years 1998, 1999 and 2000; and WHEREAS, Council and the Administration have reviewed such proposal and do desire to ratify and adopt such agreement; and WHEREAS, this Ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare, and for the usual daily operation of municipal services; now, therefore BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1: That the Mayor be and is hereby authorized and directed to enter into an Agreement the Ohio Fraternal Order of Police, Ohio Labor Council, Inc. on behalf of the Corrections Officers, Division of Police, on the terms and conditions, contained in the Agreement, which is made a part hereof as though fully rewritten herein, a copy of which is on file in the Office of the Director of Law, and as approved by the Director of Law. Section 2: It is found and determined that all formal actions of this Council concerning and relating to the passage of this Ordinance were passed in an open meeting of this Council and that all deliberations of ~ Council and any of its committees that resulted in such actions were in meetings open to the public and in compliance with legal Requirements. Section 3: That any and all ordinances in conflict with the express provisions of this Agreement are superseded by this Agreement. Section 4: That this Ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shah take effect and be in force immediately upon its adoption and approval by the Mayor;, otherwise, it shall take effect and be in force after the earliest period allowed by law.
