<br />PLACED ON 1ST mMD~&REFEí ' ill <br />'--",,--, -'- .~- <br />COMMITTEE OF THE WHOLE ~/8/98. <br /> <br />TO THE <br /> <br />5 úB5n,v-W!> qf'l <br /> <br />ORDINANCE NO 44-98 <br /> <br />AN ORDINANCE REPEALING THE MONTHLY WATER CUSTOMER SERVICE <br />CHARGE CONTAINED IN SECTION 915.02 OF THE CODIFIED ORDINANCES OF <br />THE CITY OF LAKEWOOD AND DECLARING AN EMERGENCY <br /> <br />Whereas, a petition for-the proposed Ordinancerepealing Section 915.02 of the <br />Codified Ordinances of the City of Lake wood, Customer Service Charge has been <br />,submitted; - <br /> <br />Whereas, it has been detelTIlined that said petition contains sufficient number of <br />valid signatures; <br /> <br />Whereas, the committee of the petitioners has requested that the proposed <br />Ordinance be submitted to the electors for their approval; <br /> <br />Whereas, it is the duty of Council to forthwith make provisions for the submission <br />of said proposed Ordinance to the electorate of the City of Lakewood at an election to be <br />held pursuant to law; <br /> <br />Now, Therefore, be it ordained by the Council of the City of Lakewood, <br />Cuyahoga County, Ohio; <br /> <br />Section 1. There shall be submitted to the electors of the City of Lakewood at <br />a municipal election to be held, as is provided by law, the proposed Ordinance repealing <br />Section 915 02 ofthe Codified Ordinauces ofthe City of Lake wood, Customer Service <br />Charge. <br /> <br />Section 2 That Section 915 02 of the Codified Ordinauces of the City of <br />Lakewood, Customer Service Charge as stated below shall be repealed in its entirety' <br /> <br />915 02 CUSTOMER SERVICE CHARGE <br /> <br />(A) There is hereby established a monthly water-customer service charge to be <br />charged by the Lakewood Division of Water and Wastewater Collections. <br /> <br />. <br /> <br />(B) The Director of Public Works shall aunnally set the monthly water customer <br />service charge no later than December 15 of each year to be effective January 1 of <br />the following year, such customer service charge shall be the budgeted <br />expenditures of the Water Meters Section oithe Division of Water and <br />Wastewater Collections divided by the total number of water bulls issued <br />annually. <br /> <br />Section 3 The ballots for said election shall, at the top thereof, be entitled <br />"Proposed Ordinance Ballot" and the question to be submitted on said BaUot shall be in <br />the words following: "An Ordinance Repealing the Monthly Water Customer Service <br />Charge contained in Section 915 02 ofthe Codified Ordinauces of the City of <br />Lakewood." In the appropriate position below shall be placed the following, "For the <br />Ordinance" and "Against the Ordinance" <br /> <br />Section 4. The Clerk of Council is directed to certify a copy of this ordinance <br />to the Board of Elections of Cuyahoga County, and to take all further action required by <br />law relative to the submission of said proposed Ordinance at said election. <br /> <br />1 <br /> <br />EXHIBIT A <br />
