<br /> AN EMERGENCY ORDINANCE, authorizing and directing the Mayor and Director of
<br />Public Works, for and on behalf of the City of Lakewood, to accept a conveyance and dedication of
<br />certain improved land situated at 12910 Detroit Avenue, in the City of Lakewood, Ohio.
<br />
<br /> WHEREAS, Tim LaGanke, Sr., d.b.a. Quickchange Operating Company, Ltd., having
<br />offices at 12660 Chillicothe Road, Chesterland, Ohio 44026, holds title in fee simple to a certain
<br />improved parcel of land situated at 12910 Detroit Avenue in the City of Lakewood, Cuyahoga County,
<br />State of Ohio;
<br />
<br /> WHEREAS, Quickchange Operating Company, Ltd., desires to convey and dedicate title to
<br />said parcel of land to the City;
<br />
<br /> WHEREAS, the City has entered into an agreement with Quickchange Operating
<br />Company, Ltd., dated August 10, 1998, a copy of which is attached hereto as Exhibit 'A" and
<br />incorporated by reference herein (the 'Agreement"), for the purpose of obtaining said parcel of land by
<br />dedicated Plat for good and valuable consideration, the receipt and legal sufficiently of which was
<br />acknowledged within said Agreement;
<br />
<br /> WHEREAS, this Council determines that it is in the best interest of the City to accept the
<br />conveyance of said parcel of land as a dedicated plat, in the form attached hereto as Exhibit 'B' and
<br />incorporated by reference herein (the 'Plat'); and
<br />
<br /> WHEREAS, this Council by two.thirds vote of the members elected thereto determines that
<br />this ordinance is an emergency measure which is necessary for the immediate preservation of the public
<br />peace, property, health, safety and welfare and for the usual daily operation of the City.

<br />BE IT ORDAINED BY THE CiTY OF LAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That pursuant to the conditions of the aforementioned Agreement, Coundi
<br />hereby formally approves the acquisition of said property heminabove described, includin$ the terms
<br />and conditions set therein, and authorizes the Finance Director to expend funds, if necessary, to
<br />complete the conveyance and dedication described under said Agreement.

<br /> Section 2. That the Mayor and Director of Public Works, on behalf of the City of
<br />Lakewood, are hereby authorized and directed to accept the conveyance and dedication of the Plat, with
<br />such additional provisions as am acceptable to and deemed necessary by the Director of Law to protect
<br />the public interest.
<br />
<br /> Section 3. It is found and determined that all formal action of this Council concerning
<br />and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that
<br />all such deliberations of this Council and of any of its committees that resulted in such formal action,
<br />were in meetings open to the public, in compliance with all legal requirements.
<br />
<br /> Section 4. This ordinance is hereby declared to be an emergency measure necessary for
<br />the immediate preservation of the public peace, property, health, safety and welfare in the City of the
<br />reasons set forth and defined in the preamble to this ordinance, and provided it receives the affirmative
<br />vote of two-thirds of all members elected to Council, this ordinance shall take effect and be in force
<br />immediately upon its adoption by the Council and approval by the Mayor and Director of Public Works;
<br />otherwise, it shall take effect and be in force after the earliest period allowed by law.
