Corrigan, FitzGerald, George. <br />ORDINANCE NO. 13-99 BY: Roth, Seelie, Skindeli, Smit?. <br /> <br /> AN EMERGENCY ORDINANCE to repair and resurface Riverside Drive (Sr-237) from <br />the Cleveland/Lakewood Corporation Line at Hogsback Lane to Hilliard Road in the City of <br />Lakewood, a distance of 0.23 miles more or less, as part of a larger resurfacing project <br />starting at Puritas Road in the City of Cleveland, hereinafter referred to as the improvement. <br /> <br /> WHEREAS, the City of Lakewood, hereinafter referred to as the City, has identified the <br />need for and proposed the improvement of the public highway which is described above; and <br /> <br /> WHEREAS, the City further desires cooperation from the Director of Transportation in <br />the planning, design, and construction of said improvement; and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the <br />immediate preservation of the public health, safety, and welfare for the reason that the <br />improvement is necessary to protect the public safety; now, therefore, <br /> <br />BE IT ORDAINED BY THE CiTY OF LAKEWOOD, STATE OF OHIO <br /> <br /> Section 1. That the City hereby request the cooperation of the Director of <br />Transportation in the cost of the above described improvements as follows: <br /> The entire cost and expense of this improvement will be provided by the Department. <br />No financial participation will be required by the City. However, the City agrees to assume and <br />contribute one hundred percent (100%) of the cost of any work included in the construction <br />contract, at the request of the City, which is determined by the Director not to be part of or <br />made necessary by the imprc, vement. <br /> <br /> Section 2. That it is declared to be in the public interest that the consent of <br />said City be and such consent is hereby given to the Director of Transportation to construct <br />the above described improvement, in accordance with plans, specifications and estimates as <br />approved by the Director. <br /> <br /> Section 3. That the Mayor of the City is hereby empowered and directed on <br />behalf of the City to enter into agreements with the Director of Transportation necessary to <br />complete the planning and construction of this improvement. <br /> <br /> Section 4. That traffic control devices installed within the limits of the project <br />will conform with Section 4511 of the Ohio Revised Code. <br /> <br /> Section 5. That upon completion of said improvement, the City will therefore <br />keep said highway ol~en to traffic at all times, and <br /> a) ;,Aaintain th~. ;,nprovement in ~:ordance with the provisions of the statutes <br /> relating thereto and make ample financ4at and other provisions for such <br /> maintenance; <br /> <br />b) <br /> <br />Maintain the right-of-way and keep it free of obstruction in a manner <br />satisfactory to the state of Ohio and hold said right-of-way inviolate for public <br />highway purposes and permit no signs, posters, billboards, roadside stands <br />or other private installations within the right-of-way limits, and <br /> <br />Place and maintain all traffic control devices conforming to the Ohio Manual <br />of Uniform Traffic Control Devices on the improvement in compliance with the <br />provisions of Section 4511.11 and related sections of the Ohio Revised <br />Code. and <br /> <br />d) <br /> <br />Regulate parking in the following manner: Prohibit parking in accordance <br />with Section 4511.66 of the Ohio Revised Code, unless otherwise controllecl <br />5y :oca! nn"li~'..~:ncc or r~$olutic.:... <br /> <br /> <br />
