AN EMERGENCY ORDINANCE to repair and resurface Riverside Drive (Sr-237) from the Cleveland/Lakewood Corporation Line at Hogsback Lane to Hilliard Road in the City of Lakewood, a distance of 0.23 miles more or less, as part of a larger resurfacing project starting at Puritas Road in the City of Cleveland, hereinafter referred to as the improvement. WHEREAS, the City of Lakewood, hereinafter referred to as the City, has identified the need for and proposed the improvement of the public highway which is described above; and WHEREAS, the City further desires cooperation from the Director of Transportation in the planning, design, and construction of said improvement; and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety, and welfare for the reason that the improvement is necessary to protect the public safety; now, therefore, BE IT ORDAINED BY THE CiTY OF LAKEWOOD, STATE OF OHIO Section 1. That the City hereby request the cooperation of the Director of Transportation in the cost of the above described improvements as follows: The entire cost and expense of this improvement will be provided by the Department. No financial participation will be required by the City. However, the City agrees to assume and contribute one hundred percent (100%) of the cost of any work included in the construction contract, at the request of the City, which is determined by the Director not to be part of or made necessary by the imprc, vement. Section 2. That it is declared to be in the public interest that the consent of said City be and such consent is hereby given to the Director of Transportation to construct the above described improvement, in accordance with plans, specifications and estimates as approved by the Director. Section 3. That the Mayor of the City is hereby empowered and directed on behalf of the City to enter into agreements with the Director of Transportation necessary to complete the planning and construction of this improvement. Section 4. That traffic control devices installed within the limits of the project will conform with Section 4511 of the Ohio Revised Code. Section 5. That upon completion of said improvement, the City will therefore keep said highway ol~en to traffic at all times, and a) ;,Aaintain th~. ;,nprovement in ~:ordance with the provisions of the statutes relating thereto and make ample financ4at and other provisions for such maintenance; b) Maintain the right-of-way and keep it free of obstruction in a manner satisfactory to the state of Ohio and hold said right-of-way inviolate for public highway purposes and permit no signs, posters, billboards, roadside stands or other private installations within the right-of-way limits, and Place and maintain all traffic control devices conforming to the Ohio Manual of Uniform Traffic Control Devices on the improvement in compliance with the provisions of Section 4511.11 and related sections of the Ohio Revised Code. and d) Regulate parking in the following manner: Prohibit parking in accordance with Section 4511.66 of the Ohio Revised Code, unless otherwise controllecl 5y :oca! nn"li~'..~:ncc or r~$olutic.:...
