<br />(1) A clearly visible electric or mechanical signal device gives <br />warning of the Immediate approach of a train; <br />(2) A crossing gate is lowered; <br />(3) A flagperson gives or continues to give a <br />signal of the approach or passage of a train; <br />(4) A train approaching within approximately 1,500 feet of <br />the highway croSsing emits a signal audible from that <br />distance and the train, by reason of its speed or <br />nearness to the crossing, is an immediate hazard; <br />(5) An approaching train is plainly visible and is in hazardous <br />proximity to the crossing. <br />(6) There is insufficient space on the other side of the <br />railroad grade crossing to accommodate the vehicle the <br />person is.operating without obstructing the passage of <br />other vehicles, trackless trolleys, pedestrians, or railroad <br />trains, notwithstanding any traffic contròl signal <br />indication to proceed. <br /> <br />(b) No person shaii drive any vehicle through, around or under any <br />crossing gate or barrier at a railroad crossing while the gate or barrier at a railroad <br />crossing while the gate or barrier is closed or is being opened or closed. <br /> <br />(c) Whoever violates subsections (a) or (b) above is guilty of a <br />misdemeanor of the first degree. <br /> <br />Section 3. It is found and determined that aii formal actions of this <br />Council concerning and relating to the passage of this ordinance were adopted in an <br />open meeting of this Council, and that aii such deliberation of the Council and of any of <br />its committees that resulted in such formal action were in meetings open to the public <br />in compliance with aii legal requirements. <br /> <br />Section 4.
