WHEREAS, the Policy Committee directed staff on December 14, 1999, to conduct the <br />required written notifications, the thirty-day public review and comment period (conducted <br />January 26 through February 24, 2000), and a public hearing (held on March 6, 2000) to provide <br />thc public ample opportunity to provide input regarding thc content of this Plan; and <br /> <br /> WHEREAS, the Policy Cornmittce, after consideration of comments and <br />recommendations received concerning thc Draft Plan Update, made certain modifications to thc <br />Draft Plan Update and has adopted and submitted to this legislative authority a copy of the Draft <br />Plan Update as so modified (thc "Solid Waste Management Plan DRAFT UPDATE 2001 - <br />2015"); and <br /> <br /> WHEREAS, this legislative authority is required by Division (B) Section 3734.55 of the <br />Revised Code to approve or disapprove the Draft Plan Update within 90 days after receiving a <br />copy of the Draft Plan Update and been requested to approve the Draft Plan Update; and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing for the usual <br />daily operation cfa municipal department in that creation cfa separate fund will allow the City to <br />provide accurate information pertinent to the Cuyahoga County; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. Lakewood City Council hereby approves the Solid Waste Management Plan <br />Update 2001-2015 of the Cuyahoga County Solid Waste Management District in the form <br />submitted to this Council and presently on file with the Clerk of Council. <br /> <br /> Section 2. The Clerk of Council is hereby authorized and directed to mail or otherwise <br />deliver promptly a certified copy of this ordinance to the Cuyahoga County Solid Waste <br />Management Policy Committee. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency measure necessary <br />in order to preserve the public interests, and for the further reason that the immediate <br />effectiveness of this ordinance ~s required in order to permit the early submission of the Draft <br />Plan Update to the Director of the Ohio Environmental Protection Agency for final approval <br />which is prerequisite to the implementation of the Plan and provision thereby for the efficient and <br />sanitary management of solid wastes in the District and this municipality; wherefore, this <br />ordinance shall take effect and be in force immediately upon its passage [and approval by the <br />Mayor]. <br /> <br /> Section 4. If is found and determined that all formal actions of this Council concerning <br />and relating to the passage of this Ordinance were adopted in an open meeting of this Council, <br />and that all such deliberation of the Council and of any of its committees that resulted in such <br />formal action were in meetings open to the public and in compliance with all legal reqmrements. <br /> <br />Approved: <br /> <br /> <br />
